DECISION
of Central Election Commission
of the Republic of Azerbaijan
on consideration of an appeal # 50 of November 24, 2009
submitted by the authorized representative of Musavat Party
in municipal elections appointed to December 23, 2009
On November 24, 2009, the authorized representative of Musavat Party applied to the Central Election Commission of the Republic of Azerbaijan with a written appeal regarding the candidates nominated on behalf of the party to the membership in the appropriate municipalities of Khachmaz village constituency # 56 Mustafayev Bahruz Abgul, Amrakh Heybat Salman, Qurbanov Sahib Ismayil, Hajiyev Bashir Anvar, Chobanov Nasib Sadar, Yusifov baba Aliheydar, Hajiyev Javid Islam, Atamaliyev Hajibala Hajibala, Abdullayev Gulbaba Safar and Ramazanov Shovket Alishan. The appeal stated that the ConECs mentioned above illegally refused to register the candidates and requested to undertake appropriate measures defined by law.
As the appeal corresponds to the requirements of Articles 112 and 112-1 of Election Code of the Republic of Azerbaijan and Instruction “on rules for filing and processing of complaints and appeals on the violation of election rights by the Central Election Commission of the Republic of Azerbaijan and constituency election commissions”, a member of the expert group, established within the Central Election Commission, investigated the appeal and made an appropriate opinion which was considered on the meeting of the Central Election Commission.
As a result of investigation, it was determined that the appeal is grounded, it should be satisfied, the decision of the constituency election commission on refusal of registration of the candidates to the municipality membership should be cancelled, and the candidates should be registered for the membership in the appropriate municipalities.
Based on the statements mentioned above and in accordance with Articles 19.4, 28.2, 112 and 112-1 of Election Code of the Republic of Azerbaijan and provisions 1,2,4,6, and 7 of the Instruction “on rules for filing and processing of complaints and appeals on the violation of election rights by the Central Election Commission of the Republic of Azerbaijan and constituency election commissions”, the Central Election Commission of the Republic of Azerbaijan decides:
- To satisfy the appeal # 50 submitted by the authorized representative of Musavat Party Gulaga Aslanly and to cancel the decisions # 24/2, 24/3, 24/4, 24/5, 24/6, 24/7, 24/8, 24/9, 24/10, 24/11 of November 21, 2009 adopted by Khacmaz village constituency # 56;
- To register candidates nominated by Musavat Party Mustafayev Bahruz Abdul for Niyazoba municipality, Amrakh Heybat Salman and Qurbanov Sahib Ismail for Narajan municipality, Hajiyev Bashir Anvar for Kohna Khudat municipality, Chobanov Nasib Safar for Godakli municipality, Yusifov Baba Aliheydar for Murshudov municipality, Hajiyev Javid Islam for Pirquluoba municipality, Atamaliyev Hajibala for Uzunova municipality, Abdullayev Gulbaba Safar for Qusarchay municipality and Ramazanov Shovket Alishan for Murshudoba municiplaity.
- The decision comes into force from the day of its publication.
