DECISION
of Central Election Commission
of the Republic of Azerbaijan
on the consideration of the appeal # 20 dated on 18 November 2009 by the authorized representative of Hope Party in Municipal Elections appointed to 23 December 2009
In Municipal Elections appointed to 23 December 2009, the authorized representative of Hope Party appealed to the Central Election Commission in written form on 18 November 2009 and informed that the registration of the candidates nominated by Hope Party on Shaki village first Con.EC # 114 was refused without any ground and the authorized representative asked for taking relevant measures on this.
The appeal was investigated by the member of Expert Group under the Central Election Commission pursuant to Articles 112, 112-1 of Election Code and “Instruction on the rules for submitting complaints and appeals related to violating suffrage to Central Election Commission and Constituency Election Commissions and considering them” and relevant opinion was provided on this and it was considered at the session of the Central Election Commission.
It was determined at the result of investigation that the decision of the Con.EC on the refusal from registering the above-mentioned persons was adopted by violating Article 60.1 of Election Code of the Republic of Azerbaijan.
Therefore, the relevant decision of Shaki village first Con.EC # 114 shall be annulled, the issue on the registration of the candidates shall be re-considered and the relevant Con.EC shall be tasked with adopting grounded decision on separately each of candidates.
Taking the above mentioned as a basis, pursuant to Articles 19.4, 28.2, 60.1, 112, 112-1 of Election Code of the Republic of Azerbaijan and Item 1,2,4,6 and 7 of Instruction “on submission and investigation of complaints and appeals on violation of election rights by Central Election Commission of the Republic of Azerbaijan and constituency election commissions” the Central Election Commission shall decide:
- The complaint # 20 of the authorized representative of Hope Party, dated on 18 November 2009 shall be partly implemented and decision # 37/75 of Shaki village first Con.EC # 114 shall be annulled.
- By re-considering the issue of registering candidates, the adoption of grounded decision on each candidate shall be tasked to Shaki village first Con.EC # 114.
- Decision shall come into force from the moment of its publication.
