DECISION
of Central Election Commission
of the Republic of Azerbaijan
on the establishment of Expert Group under Central Election Commission
of the Republic of Azerbaijan in the aim of investigating the complaints of the actions (inactions) and decisions violating citizens’ suffrage
By decision # 29/103 of Central Election Commission of the Republic of Azerbaijan (CEC), dated on 7 October 2009, the following Municipal Elections in the Republic of Azerbaijan has been appointed to 23 December 2009. Pursuant to election legislation, Expert Groups shall be established under election commissions within the period and manner defined by legislation in the aim of investigating the complaints of the actions (inactions) and decisions violating citizens’ suffrage.
Pursuant to Article 112-1.1 of Election Code of the Republic of Azerbaijan and item # 5.1 of Instruction “On submitting the appeals and complaints on the violation of suffrage to the Central Election Commission of the Republic of Azerbaijan and Constituency Election Commissions and their consideration”, Expert Groups shall be established consisting of 9 persons under the CEC and 3 persons under the Con.EC in the aim of investigating the complaints of the actions (inactions) and decisions violating citizens’ suffrage which include lawyer members of the relevant election commissions that function during every election (referendum), as well as other members of election commissions who meet the principles as professionalism, proficiency of conducting precise factual and legal analysis, practice in the field of elections, public confidence in impartiality of his/her activity and Secretariat officials.
In the aim of increasing the fairness and genuineness of investigating such kind of complaints and appeals entered election commissions, the above-mentioned rule has been successfully applied in election (referendum) practice of the Republic of Azerbaijan and at the present it is necessary to continue this practice in the following Municipal Elections.
By adopting the above-mentioned as a basis and pursuant to Articles 19.4, 19.14, 28.2, 28.4, 112-1.1 of Election Code of the Republic of Azerbaijan and item # 5.1 of the above-mentioned Instruction, CEC decides:
1. In the aim of investigating the complaints of the actions (inactions) and decisions violating citizens’ suffrage, Expert Group shall be established in the following composition consisting of 9 persons under CEC during the following Municipal Elections, appointed to 23 December 2009:
Ramiz Ibrahimov – Member of Central Election Commission of the Republic of Azerbaijan
Gabil Orujov - Member of Central Election Commission of the Republic of Azerbaijan
Valida Kazimova - Member of Central Election Commission of the Republic of Azerbaijan
Tofig Hasanov - Member of Central Election Commission of the Republic of Azerbaijan
Rovshan Ismayilov - Member of Central Election Commission of the Republic of Azerbaijan
Nizami Nadirov - Member of Central Election Commission of the Republic of Azerbaijan
Irada Hajiyeva – Head of Law department of the Secretariat of Central Election Commission of the Republic of Azerbaijan
Rafig Abbasov – Chief adviser of Law department of the Secretariat of Central Election Commission of the Republic of Azerbaijan
Emin Guliyev – junior adviser of Law department of the Secretariat of Central Election Commission of the Republic of Azerbaijan
2. The establishment of Expert Group under the Con.ECs during the short period which meet the relevant requirements shall be tasked with this election commission.
3. The decision shall be published within 24 hours.
4. Decision shall be enforced since the day of its publication.
