. : CONSIDERATION OF COMPLAINTS AND APPEALS

 

OPINION

of Mr. Emin Guliyev, Member of Expert Group under Central Election Commission of the Republic of Azerbaijan established with the aim of investigating the complaints of actions (inactions) and decisions that violate citizens’ suffrage on investigating the appeals by Abbasagha Huseynbala oghlu Mammadov, authorized representative of Hope Party related with Municipal Elections appointed to 23 December 2009

In Municipal Elections appointed to 23 December 2009, A.Mammadov, authorized representative of Hope Party appealed to the Central Election Commission in written form and informed that the registration of the candidates nominated by Hope Party on Shaki village first Con.EC # 114 was refused without any ground and the requirements of Election Code were offended.
Therefore, the authorized representative asked for taking relevant measures on this.
In the process of investigation, complainer A.Mammadov was kept contact with and informed on his rights to present additional evidences on the cases indicated in the appeals. He was also informed on the right to participate in the investigation. The authorized representative stated that he had not any additional evidence to present except the information included in the complaint.
As the appeal had been legally compiled pursuant to Election Code and “Instruction on the rules for submitting complaints and appeals related to violating suffrage to Central Election Commission and Constituency Election Commissions and considering them” and submitted in the defined period, it was adopted to investigation.
I, member of Expert Group Emin Guliyev defined and investigated the appeal entered the Central Election Commission by Abbasagha Huseynbala oghlu Mammadov, authorized representative of Hope Party in Municipal Elections appointed to 23 December 2009.
By considering the above-mentioned, pursuant to Articles 112, 112-1, 60.1 of Election Code of the Republic of Azerbaijan and items # 1, 2, 4 and 6, 7 of Instruction “on the rules for submitting complaints and appeals related to violating suffrage to Central Election Commission and Constituency Election Commissions and considering them”, I came to conclusion:

  1. The complaint shall be implemented.
  2. The decision shall be sent to the Con.EC for re-consideration.
  3. The opinion shall be published within 24 hours since its adoption (it shall be located on the web site of the Central Election Commission) and its copy shall be sent to the authorized representative.
