On July 18, the
Central Election Commission adopted decision on division
of the territory of the Republic of Azerbaijan in 100
majority constituencies according to the requirements
of the Law “On Elections to the Milli Majlis of the
Republic of Azerbaijan” and on the approval of their
scheme and graphic description. Presence of 43.050 voters
in one-mandate constituency was defined as single representation
norm by this decision. As a rule, the maximum limit
of single representation norm was defined 40.900 voters
(in remote districts maximum limit- 47.350 and minimum
limit 38.750 voters) provided that the number of voters
should not exceed 5 % of representation norm within
the borders of the constituency and should not exceed
or be less than 10 % of representation norm in remote
districts.
The Central Election Commission helped the Ministry
of Foreign Affairs to guarantee voting rights to Azerbaijani
citizens living abroad. According to the information
on the number of Azerbaijani citizens who live abroad
permanently or are on long-term official trips and are
to vote abroad, the list of relevant one-mandate constituencies
in the republic where they belong was approved.
99 Constituency Election Commissions (Con.ECs) each
consisting of 9 persons were established in 99 constituencies
based on 1/3 principle till August 7 pursuant to the
Law “On Elections to the Milli Majlis of the Republic
of Azerbaijan”. As it is impossible to conduct elections
in Khankendi constituency # 42 occupied by Armenian
arm forces, not any Con.Ec was established there.
891 members with decisive rights were appointed to the
composition of Con.ECs. 297 persons of them represented
the New Azerbaijan Party, 152 persons the Azerbaijan
Popular Front Party, 145 persons the Azerbaijan National
Independence Party and 297 persons non-parties. Furthermore,
registered candidates to deputy nominated by initiators
pursuant to the law on one-mandate constituencies, as
well as political parties and blocks of political parties
that made single candidates list on multi-mandate constituencies
to be registered were entitled the right to appoint
members with consultative rights to the composition
of Con.ECs and Precinct Election Commissions (PECs).
More than 1.000 members with consultative rights were
appointed to the composition of Con.ECs and PECs by
political parties.
Con.ECs ended the establishment of polling stations
by agreement of heads of relevant executive bodies and
municipalities till September 16, 2002 – at least 50
days prior to the voting day. 4.976 precincts were formed
in all. In order to guarantee voting rights to Azerbaijan
IDP citizens, separate precincts were established in
areas closely settled by them, as before.
Precincts, as well as PECs were established in embassies
of the country to abroad and diplomatic representations
in order to ensure the vote of the citizens of the Republic
of Azerbaijan who are in foreign countries at least
30 days prior to the voting, i.e. till October 6.
A lot was done in the field of compilation, specification
and submission of voters lists in order to increase
voters activity and ensure their voting rights. 4.318.000
Azerbaijani citizens were included in voters lists on
the republic. Voters lists were submitted in order to
make voters aware of them and make additional specifications
at least 25 days prior to the voting, i.e. on October
11.
Since August 21, nomination of candidates to deputy
on one-mandate constituencies by the citizens of the
republic, political parties and blocks of political
parties commenced.
After the inspection of notification documents on indication
of candidates, as well as voters signature sheets by
commissions, 408 candidates to deputy were registered
and their lists were declared. Afterwards, this number
was decreased to 390 persons because of candidates who
had withdrew their candidacy and persons excluded from
candidates lists by decision of the Central Election
Commission. Besides non-parties, citizens representing
33 political parties were included in candidates lists
on one-mandate constituencies. Members of political
parties constituted 63,3 % of candidates put to vote
and non-parties 36,7 %.
14 of political parties functioning pursuant to the
legislation of the republic appealed to the Central
Election Commission to participate in elections on proportional
system. As 9 of them made violations in the collection
of voters signatures and submitted not proper information
they could not register single candidates lists and
only 5 of them allowed to participate in elections by
compiling and submitting their notification documents
pursuant to the requirements of the law.
Upon adopting item # 10 of Article 2.2 of the Law “On
the Central Election Commission of the Republic of Azerbaijan”
as a basis, the Central Election Commission adopted
the relevant decision on the registration of single
candidates list of the Musavat Party, Azerbaijan Democrat
Party, Azerbaijan Popular Democratic Party, National
Congress Party, Alliance Party for the sake of Azerbaijan,
Azerbaijan Democratic World Party and Azerbaijan Liberal
Party besides the single candidates lists of the previously
registered New Azerbaijan Party, Azerbaijan Popular
Front Party, Azerbaijan National Independence Party,
Civil Solidarity Party and Azerbaijan Communist Party.
Parties for national statehood, national movement and
democratic enlightenment registered by the Central Election
Commission decided to participate in elections as blocks
of political parties and “Democratic Azerbaijan” Block
of Political Parties was registered for the first time
in the practice of parliamentary elections of the country.
325 candidates in main candidates list of 12 political
parties and a block of political parties which are to
participate in elections on proportional election system
competed for 25 deputy mandates.
Works done during elections and statistic information
on the voters participation on November 5 were broadcasted
to the world in operative order in 5 foreign languages.
Dialogue methods of conferences and direct correspondences
were used in “Internet” pages.
The State Automated Information System applied for the
first time in election practice of the republic had
much importance in compilation of voters lists, defining
election procedure and results and gathering together
of the information by election commissions and their
broadcast via TV. Automated election system was also
used during the voting in 13 precincts on 11 constituencies
for re-elections to the Milli Majlis.
Voting was conducted since 8 till 19 on November 5,
2000 – on the Election Day. Each voter voted with 2
ballot papers on single multi-mandate and ballot papers
on one-mandate constituencies freely and voluntarily.
Upon defining voting results within 10 days after elections,
the Commission submitted its decision together with
necessary documents to the Constitution Court of the
Republic of Azerbaijan pursuant to Article 85 of the
Constitution of the Republic of Azerbaijan and to item
#1 of Article 75 of the Law “On Elections to the Milli
Majlis of the Republic of Azerbaijan” to be inspected
and approved.
Results of the elections to the Milli Majlis conducted
on November 5, 2000 were discussed in the session of
the Constitution Court on November 22, 2000. The Constitution
Court noted that the followings were defined by the
minutes of session dated on November 14, 2000 on election
results on single multi-mandate constituencies and on
the comprehension of deputy mandates by political parties
and blocks of political parties:
- total number of voters in voters lists on precincts
of constituencies – 4.212.915;
- number of ballot papers issued to voters on the Election
Day – 3.000.198;
- number of unused and canceled ballot papers – 1.140.341;
- number of ballot papers considered valid – 2.897.864;
- number of ballot papers considered invalid – 100.434;
- number of votes for single candidates list of political
parties and blocks of political parties.

Generally, 13.253 votes were cast in favor of single
candidates list of political parties and blocks of political
parties participated in elections on proportional election
system.
The Constitution Court considered results of elections
to the Milli Majlis of the Republic of Azerbaijan on
November 5, 2000 on single multi-mandate constituency
and 88 one-mandate constituencies valid. 2.783.205 voters
participated in the voting on these constituencies and
this constitutes 71,33 % of the total number of citizens
in voters lists. Consequently, 113 deputies were elected
to the Milli Majlis – 88 of them on one-mandate constituencies
and 25 on single multi-mandate constituencies.
The Central Election Commission considered election
results invalid in 4 constituencies related to the applications
got during elections and after it: in Khatai second
constituency # 10, Sumgayit first constituency #38,
Aghsu-Kurdamir constituency #51 and Imishli constituency
#68 and some complaints based on election results were
sent to relevant Con.ECs and prosecutor’s offices for
their investigation and taking measures.
Then, investigation of complaint applications was continued
and the Central Election Commission revealed law violations
affected election results in other 4 constituencies:
Yasamal second #7, Barda city #56, Gusar #65 and Hajigabul-Salyan
#94 and appelad to the Constitution Court for their
consideration. Election results on these constituencies,
as well as 3 constituencies where serious law violations
have been revealed by the Constitution Court, i.e. in
Khatai first #9, Astara #53 and Shamkir city #9 were
not approved.
So The Constitution Court approved results of elections
in 88 one-mandate constituencies out of 99 conducted
on November 5, 2000.
According to the Decree of President of the Republic
of Azerbaijan dated on November 25, 2000 re-elections
to the Milli Majlis were appointed to January 4, 2001
in remaining 11 constituencies. On December 18, the
date of conduct of elections was changed and appointed
to January 7, 2001 by considering recommendations on
this of OSCE/ODIHR and Council of Europe to ensure the
participation of international observers more thoroughly
during re-elections to the Milli Majlis by Decree of
the President.
Con.ECs and PECs were established in a new composition
by 1/3 principle in constituencies for these elections.
On December 25, seminar conference of chairmen of Con.ECS
related to re-elections was conducted in the Central
Election Commission.
During re-elections to the Milli Majlis 147 citizens
got signature sheets from Con.ECs for nomination of
their candidacies to deputy and 111 persons of them
submitted notification documents (as well as completed
signature sheets) to commissions. Candidacies of 90
persons of them were registered in Con.ECs and 14 persons
withdrew their candidacies afterwards. During re-elections
34 persons of 76 candidates whose names have been included
in ballot papers were non-parties and 37 of them representatives
of 9 political parties.
The Constitution Court discussed entered results of
re-elections to the Milli Majlis conducted on January
7, 2001 in 11 constituencies pursuant to Article 86
and item 5 of Article 130 of the Constitution of the
Republic of Azerbaijan. Results of re-elections to the
Milli Majlis in constituencies – Yasamal #7, Khatai
first #9, Khatai second #10, Sumgayit first #38, Aghsu-Kurdamir
#51, Astara # 53, Barda #56, Gusar #65, Imishli #68,
Hajigabul-Salyan #94 and Shamkir city #99 defined by
relevant Con.ECs were approved.
During re-elections to the Milli Majlis 71,33 % of 480.185
citizens included in voters lists on 544 precincts of
11 constituencies participated in the voting.
In general, 68,93 % of voters in the voters lists on
4.964 precincts participated in elections to the Milli
Majlis of the Republic of Azerbaijan called for the
second time in 99 constituencies conducted on November
5, 2000 and on January 7, 2001.
2.926.904 ballot papers were considered valid and 2.888.813
persons voted in favor of candidates whose names were
included in ballot papers and 38.091 persons against.
27 % of deputies elected to the Milli Majlis of the
Republic of Azerbaijan on one-mandate constituencies
constituted non-parties and 73 % party members.
After the official publication of general election results,
the Central Election Commission of the Republic of Azerbaijan
registered elected deputies pursuant to item 4 of Article
77 of the Law “On elections to the Milli Majlis of the
Republic of Azerbaijan” and M.M. Panahov, chairman of
the Central Election Commission provided them with cards
in the building of the Commission Apparatus on December
13, 2000.
During election campaign the Central Election Commission
conducted 53 sessions, in these sessions 203 different
issues were considered and 192 decisions were adopted.
It is an important event that the composition of the
Central Election Commission formed from representatives
of political parties whose deputies elected on single
multi-mandate constituencies take majority in the Milli
Majlis, non-parties and representatives of political
parties whose deputies take minority functioned jointly
in accordance with 1/3 principle and it was possible
to adopt important decisions notwithstanding principal
views divergence on the discussion of some issues.
