DECISION

of Central Election (Referenda) Commission
of the Republic of Azerbaijan

on consideration of application submitted by authorized representative of referendum initiative group “Respublikachilar” Gulaga Aslanly in referendum appointed for March 18, 2009

With regard to referendum appointed for March 18, 2009, an authorized representative of referendum initiative group Gulaga Aslanly applied on January 21, 2009 to Central Election (Referendum) Commission of the Republic of Azerbaijan claiming that during the process of signatures collecting in Tezekend village of Jalilabad region, persons who put their signatures are pressured and requested to undertake appropriate measures determined by law.
As the appeal corresponds to requirements of Article 112.1 of Election Code of the Republic of Azerbaijan, it was investigated by a member of an expert group established within Central Election (Referendum) Commission to consider citizens’ complaints in accordance with Article 112.1-1 and relevant opinion was provided on it which was considered at the meeting of Central Election (Referendum) Commission.
As a results of investigation, it was determined that with the purpose of collecting signatures, the persons representing interests of referendum initiative group “Respublikachilar” collected signatures from one group of residents of Tezekend village by providing to them false information and violating requirements of Election Code of the Republic of Azerbaijan. In this regard, the same residents informed the representative of village executive authority, chairman of village municipality and field inspector on this issue claiming that their rights were violated. At the same time, no pressure was made by these authorized persons to the citizens put their signatures and persons representing interests of relevant referendum initiative group.
On this basis, the application of the authorized representative of referendum initiative group “Respublikachilar” Gulaga Aslanly shall not be satisfied due to lack of grounds.
On the basis mentioned above, pursuant to Article 112, 112-1 of Election Code of the Republic of Azerbaijan and Item 1,2,4,6 and 7 of Instruction “on submission and investigation of complaints and appeals on violation of election rights by Central Election Commission of the Republic of Azerbaijan and constituency election commissions” the Central Election Commission shall decide:   

  1. The application of the authorized representative of referendum initiative group “Respublikachilar” Gulaga Aslanly shall not be satisfied due to lack of grounds.

  2. The decision shall come into force since the moment of its publication.
