DECISION
of Central Election (Referenda) Commission
of the Republic of Azerbaijan
on consideration of application submitted by authorized representative of “Republicans” referendum initiative group” Gulaga Aslanly in referendum appointed for March 18, 2009
With regard to referendum appointed for March 18, 2009, an authorized representative of “Republicans” referendum initiative group Gulaga Aslanly applied on February 23, 2009 to Central Election (Referendum) Commission of the Republic of Azerbaijan claiming that requirement for conducting pre-referendum campaign was violated in the release of “Khalg gazeti” paper dated on February 23, 2009 and he asked for taking relevant activities defined by law.
As the appeal corresponds to requirements of Articles 112, 112.1 of Election Code of the Republic of Azerbaijan, it was investigated by a member of an expert group established within Central Election (Referendum) Commission to consider citizens’ complaints and relevant opinion was provided on it which was considered at the meeting of Central Election (Referendum) Commission.
As a results of investigation, it was determined that the title of the campaign material of “Republicans” referendum campaign group was incorrectly typed in publication space freely allocated by “Khalg gazeti” paper.
As the fact indicated in the appeal by Gulaga Aslanly, an authorized representative of “Republicans” referendum initiative group has found its proof, his appeal shall be implemented.
On the basis mentioned above, pursuant to Article 19.4, 28.2, 85.2, 112, 112-1 of Election Code of the Republic of Azerbaijan and Item 1,2,4,6 and 7 of Instruction “on submission and investigation of complaints and appeals on violation of election rights by Central Election Commission of the Republic of Azerbaijan and constituency election commissions” the Central Election Commission decides:
- The appeal by the authorized representative of “Republicans” referendum initiative group shall be regarded as grounded and the elimination of the error allowed during locating the campaign material on the publication body shall be ensured by the editorial office.
- The decision shall come into force since the day of its publication.
