OPINION
of  Ms. Irade Hajiyeva, member of Expert Group under Central Election (Referendum) Commission of the Republic of Azerbaijan to investigate the complaints of the actions (inactions) and decisions violating citizens' suffrage on the investigation of the complaint by Hasan Kerimov, authorized representative of "Movement for Garabagh and Republic" referendum initiative group related to Referendum appointed to 18 March 2009

Hasan Kerimov, authorized representative of "Movement for Garabagh and Republic" referendum initiative group applied to Central Election (Referendum) Commission of the Republic of Azerbaijan in written form and informed on the obstacles by the officials of Binagadi district police office # 7 for some people (Shahla Hajiyeva, Natevan Mammadova) collecting signatures in support of the initiative group on 30 January of the current year and he asked for taking measures on the people who committed illegal actions.
As the appeal was compiled pursuant to Election Code and "Instruction on the rules for submitting the complaints and appeals on suffrage violation to Central Election Commission of the Republic of Azerbaijan and Constituency Election Commissions and their consideration" and submitted in the defined period, it was accepted for investigation. 
In the process of investigation, authorized representative Hasan Kerimov was kept contact with and informed on his rights to present additional evidences an participate in the investigation. He stated that he had not any additional evidence to present apart from the indicated information.
I conducted investigation on the entered appeal. at the result of investigation, it was determined that on 30 January 2009, Sh.Hajiyeva and N.Mammadova were not detained in the administrative unit of the department and taken to the department by the officials of Binagadi district police office # 7 for taking any measure on them.
The appeal by the authorized representative shall not be implemented because of groundlessness according to the above-mentioned.
Pursuant to Articles 112, 112-1 of Election Code of the Republic of Azerbaijan and items # 1, 2, 4, 6 and 7 of "Instruction on the rules for submitting the complaints and appeals on suffrage violation to Central Election Commission of the Republic of Azerbaijan and Constituency Election Commissions and their consideration", I came to conclusion:
1. The complaint by Hasan Kerimov, authorized representative of "Movement for Garabagh and Republic" referendum initiative group in referendum appointed to 18 March 2009 shall not be implemented because of groundlessness.
2. The opinion shall be published within 24 hours  since adoption (shall be posted on the web site) and its copy shall be delivered to the complainer.
