OPINION

of Press Group under Central Election Commission  implementing the control upon the abidance of the identified rules for pre-election campaign
on the appeal by Mr. Nasimi Mammadli, authorized representative of “Umid” (“Hope”) Party related to pre-election campaign in Presidential Elections appointed to October 15, 2008

The appeal related to law violation allowed in the conduct of pre-election campaign in Presidential Elections appointed to October 15, 2008 which had been submitted to Central Election Commission of the Republic of Azerbaijan (CEC) by Mr. Nasimi Mammadli, authorized representative of Hope Party on 28.09.2008 was investigated by the Press Group and defined below:
In his appeal the authorized representative points out that pursuant to Articles 80.4 and 80.7 of Election Code, Central Election Commission conducted lottery on 17 September, 2008 in the aim of airtime division for candidates to presidency on Public TV and Radio, defined speech turns of candidates and protocol was compiled on this. The rules included in the protocol were approved by the CEC decision. Mr. Hafiz Alamdar oghl Hajiyev, registered candidate to presidency nominated by Modern Musavat Party didn’t come purposely in time to the “round table”  conducted on Public TV on 26 September 2008 and consequently, he made speech not in turn defined by the protocol, but after all the candidates spoke. Mr. Nasimi Mammadli, authorized representative of Hope Party asks for taking appropriate measures related to the allowed law violation.
During the investigation, the inquiry of the representative of Public TV was listened and defined that  neither Mr. Hafiz Alamdar oghlu Hajiyev, registered candidate to presidency nor Public TV allowed law violation.
Adopting the above-mentioned as a basis, pursuant to Article 88.8 of Election Code of the Republic of Azerbaijan and Instruction “on the consideration of the complaints related to the violation of suffrage, received by Central Election Commission and Constituency Election Commissions”, Press Group arrives at such a conclusion:

  1. In response to the appeal by Nasimi Mammadli, authorized representative of Hope Party is groundless.
  2. The opinion shall be published (shall be posted on internet) and its copy shall be sent to the applicant
