RULE
for submitting information on the amount and source
of income, property of the candidate to the presidency of the Republic of Azerbaijan
The Rule regulates the issues on submitting the information on the property that belongs to candidates to presidency of the Republic of Azerbaijan basing on their right of property, amount and source of income according to Articles 58.1, 58.1.4, 58.1.5 and 58.3 of Election Code of the Republic of Azerbaijan (hereafter referred to as Election Code).
In order to register the candidate, the candidate, representative of the voters’ initiative group or the authorized representative of the candidate, political parties or political party blocs shall submit the information on the property belonging to them basing on the amount and source of income, right of property together with election documents to the Central Election Commission of the Republic of Azerbaijan.
The following sources of income shall be indicated in the information (submitting references on the totality of those incomes received from the organizations and physical persons within a year before the appointment of the elections (Appendice # 1 made to the Rule):
1. About the salary from the main working place
Salary from the main working place shall be understood as payments for the fulfilling of the works on the concrete profession, degree and post according to the labor contracts signed with the enterprises, offices and organizations or in the cooperative, agriculture, in the public or religious organization, agency, as well as for the fulfilling labor function in accordance with service and education by citizens notwithstanding of the form of property.
2. About the reward and financial support
Reward and financial support shall be understood as reward for the result of the work, reward for the service year, all sorts of the supplementary rewards related to the anniversary, holiday, birthdays and stimulating payments in the other similar cases, other rewards for the fulfilling labor functions and all sorts of financial support.
3. About the income achieved from the civic-legal contracts
Income achieved from the civic-legal contracts shall be understood as incomes achieved from amnesty, substitution and fulfilling the works out of the duty (on one occasion and substitution).
4. About the income achieved from the ownership activity
Incomes achieved from the ownership activity shall be understood as incomes (the income indicated in the declaration submitted to the organs of taxes for the final year by the physical person who is engaged in ownership) achieved from types of activity implied by the current legislation of the Republic of Azerbaijan and not prohibited by Law.
5. About the income achieved from non-ownership activity
The income achieved from non-ownership activity includes other incomes besides the incomes achieved from hired works or ownership activity. As well as:
- percentages received from banks and credit organizations;
- dividends;
- copyright;
- royalty
- income achieved from operations on securities;
- amount of the remitted debt;
- income achieved from the property rent;
- income on life’s collection insurance;
- presents and financial support from the persons who is not a member of the family;
- achieved heritage;
- lottery prizes;
- joint incomes (property and other income achieved during the marriage period of the couples, joint property and so on.);
- other incomes not prohibited by law.
6. The property information shall be approved by the references achieved from the relevant organizations conducting the registration of the property right.
7. The candidate to presidency shall submit the information on the property belonging to him/her basing on the property right pursuant to Appendice # 5 made to the Election Code of the Republic of Azerbaijan.
