I N S T R U C T I O N
on rules for providing members of Constituency and Precinct Election Commissions with salary
Members of Constituency and Precinct Election Commissions shall receive compensation from the State budget during preparation and conduct of elections, as well as during term of office of election commissions pursuant to Articles 33, 38 and 89 of the Election Code of the Republic of Azerbaijan.
The Central Election Commission transfers the funding required for conduct of elections to Constituency Election Commissions at least 45 days prior to the voting day, they distribute the received funding among Precinct Election Commissions at least 10 days prior to the voting day. During the conduct of by-elections, during elections or if whole financing is not possible, election commissions distribute and transfer the funding as it enters.
Chairmen of election commissions give orders on the funding allocated for preparation and conduct of elections and are responsible for compatibility of financial documents with decisions by the election commission, submitting financial reports on expenses in the case and time defined by the Election Code.The Chairman and Secretaries of a Constituency Election Commission shall be provided with salary from the State budget, during his/her term of office. The members of the Constituency Election Commission shall receive compensation from the State budget, within the period from the day of publication of the authorized state body’s decision on determination of elections up to the day of publication of the election results. The salary of the member elected to the Constituency Election Commission or of the person who serves in the place of employment, the authorities, enterprises, organizations or institutions funded from either the state or local budget, shall be preserved. Expenses of a member of a Constituency Election Commission for use any public transport (except taxi and ordered journeys) within the territory of the constituency during elections shall be paid from the funds allocated by the Constituency Election Commission, upon presenting the documents on traveling.If Constituency Election Commissions are established directly before elections, then they must be organized at least 60 days prior to the voting day and they shall be provided with compensation since the day of its formation.The Chairman, Secretaries and members of a Precinct Election Commission shall be provided with compensation from the State budget, within the period from the day of publication of the authorized state body’s decision on determination of elections up to the day of publication of the election results, as well as during annual drafting of voters lists. The salary of the member elected to the Precinct Election Commission or of the person who serves in the place of employment, the authorities, enterprises, organizations or institutions funded from either the state or local budget, shall be preserved.The day of official publication of election results is regarded a day of the publication of the decision on results of Presidential Elections by the Constitutional Court of the Republic of Azerbaijan pursuant to Article 203 of the Election Code.
Not more than 2 members of the Precinct Election Commission can be in military service. These members participate in the works of the Precinct Election Commission only during elections and their main place of employment is preserved. If Precinct Election Commissions are formed directly before elections, then they must be organized at least 40 days prior to the voting day and they shall be provided with compensation since the day of its formation.
During preparation and conduct of elections with the presentation by the relevant election commission, average monthly salary of the member of the Precinct Election Commission with decisive right to vote specified by Article 36.3 of the Election Code and who was not dismissed of his/her municipal duties is preserved and he/she shall receive supplementary salary from the relevant election commission in the case and capacity defined by the Central Election Commission.Transportation expenses, as well as transportation expenses in remote districts, expenses of official journeys related to the conduct of elections and other expenses related to the authorities and activity of election commissions are paid from the funding allocated to provide the works of election commissions.During elections employees not on the staff involved in the work of Constituency and Precinct Election Commissions on the basis of civic contracts are also provided with salary.Usage of the funding allocated for election commissions is controlled by control-inspection services established in the Central Election Commission, chairmen of Constituency Election Commissions.Providing members of election commission and officials of commission apparatus, employees involved to work in the commissionon civic contract with salary must also be included in the reports on expenditure and entrance of the funding, submitted to the Central Election Commission.
