DECISION
of Central Election Commission
of the Republic of Azerbaijan
on the establishment of lottery commission at Central Election Commission in the aim of airtime division allocated on free bases in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008
Registration of candidates to presidency in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2005 ended. Pursuant to Article 75.2 of Election Code of the Republic of Azerbaijan, since 28 days prior to the voting day, i.e. since September 17, 2008 pre-election campaign commences. Pursuant to Article 80.1 of this Code, candidates to presidency shall have the rights to obtain free airtime in public TV and Radio broadcasting companies. In accordance with Article 80.5 of Election Code, Public TV and Radio Broadcasting Company has allocated airtime at the relevant volume on free bases.
Pursuant to Articles 80.4 and 80.6 of Election Code of the Republic of Azerbaijan, lottery shall be conducted among the persons implied by Articles 74.1.3 and 74.1.6 of the Code based on the application submitted by them in the aim of allocating free airtime at equal terms and equal volume within a week after the period implied by Article 75 of this Code commences.
Pursuant to Article 80.7 of Election Code of the Republic of Azerbaijan, lottery shall be conducted by the participation of the representatives of relevant election commissions, TV and Radio broadcasting companies, as well as registered candidates, their authorized representatives, agents, agents of political parties, blocs of political parties, domestic and international observers and by publishing the official information on the place and date of conducting lottery. Lottery results shall be made official via protocol and tabulation of airtime division shall be published in periodicals implied by Article 77.2 of Election Code of the Republic of Azerbaijan.
Adopting the above-mentioned as a basis, pursuant to Articles 19.4, 19.14, 28.2, 28.4, 74, 75, 80.1 and 80.4-80.7 of Election Code of the Republic of Azerbaijan, Central Election Commission of the Republic of Azerbaijan decides:
1. In the aim of airtime division allocated on free bases by Public TV and Radio Broadcasting Company in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008, “lottery commission” shall be established in the following composition at the CEC:
Azer Taghiyev – CEC Commissioner
Fuad Javadov – CEC Commissioner
Almaz Gahramanli – CEC Commissioner
Azer Sariyev – Head of Press Department of CEC Secretariat
2. “Lottery” shall be conducted on September 17, 2008 at 12.00.
3. “Lottery commission” shall be ensured division of allocated airtime.
4. The decision shall be enforced since the day of its publication.
