DECISION
of Central Election Commission
of the Republic of Azerbaijan

on the refusal from the registration of the approved candidacy of  Mr. Ali Isa Haji oghlu Aghaevli  in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008

Candidacy of Mr. Ali Isa Haji oghlu Aghaevli, nominated on his own initiative in Presidential Elections of the Republic of Azerbaijan to be conducted on October 15, 2008, was approved by Decision # 13/66 of the session by Central Election Commission of the Republic of Azerbaijan (CEC), dated on August 20, 2008.
Signature sheets and documents attached to them were submitted to the CEC for the registration of the candidate on September 5, 2008.
CEC conducted relevant investigation related on this in time and case implied by legislation and determined bases for refusing from registration of the candidate.
So, Protocol dated on September 12, 2008 and Opinion on the same date on checking the accuracy of the signatures in signature sheets submitted by the Working Group point out that though Article 181.1 of Election Code of the Republic of Azerbaijan implies collection of valid signatures at the amount of 40 thousands in the support of the candidate, the number of  valid signatures included in the submitted signature sheets was less than the number implied by law for the registration of the candidate, furthermore, information provided about the property of the candidate was inaccurate and preliminary financial report was illegally submitted.
Pursuant to Article 59.12 of Election Code of the Republic of Azerbaijan, after excluding invalid signatures in accordance with Articles 59.6-59.10 of Election Code, if the number of the remaining voters’ signatures is less than the required number, then the candidate shall not be registered.
Pursuant to Article 60.1 of Election Code of the Republic of Azerbaijan, within 10 days after receiving signature sheets and necessary documents for the registration of the candidate, relevant election commission shall adopt decision on the registration or refusal from registering the candidate.
Adopting the above-mentioned as a basis, pursuant to Articles 19.4, 19.14, 28.2, 28.4, 53, 58-60 of Election Code of the Republic of Azerbaijan, Central Election Commission of the Republic of Azerbaijan decides:

1.  Candidacy of Mr. Ali Isa Haji oghlu Aghaevli, nominated on his own initiative shall be refused from being registered in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008.

2. The decision shall be enforced since the day of its publication.
