DECISION
of Central Election Commission
of the Republic of Azerbaijan
on the termination of the authorities of Mr. Azer Kamal oghlu Amiraslanov, Deputy of the Mili Majlis of the Republic of Azerbaijan
Mr. Azer Kamal oghlu Amiraslanov, Deputy of the third call Milli Majlis of the Republic of Azerbaijan elected on Shamkir city constituency # 98 in Parliamentary Elections conducted on November 6, 2005 by Order of Mr. Ilham Aliyev, President of the Republic of Azerbaijan was appointed to the post of head of Department for Agrarian Policy Affairs of Executive Apparatus of President of the Republic of Azerbaijan.
Relevant Order of President of the Republic of Azerbaijan entered CEC on September 5, 2008, relevant investigation was conducted in the case implied by legislation and bases were determined for depriving Deputy Azer Kamal oghlu Amiraslanov from the mandate of deputy.
Pursuant to the fourth item of part I of Article 89 of the Constitution of the Republic of Azerbaijan, deputies of the Milli Majlis of the Republic of Azerbaijan shall be deprived from mandate of deputy as long as they occupy post.
Pursuant to Article 175.3 of Election Code of the Republic of Azerbaijan, when there are bases implied by the fourth item of part I of Article 89 of the Constitution of the Republic of Azerbaijan, CEC shall adopt decision depriving from deputy mandate.
Adopting the above-mentioned as a basis, pursuant to Article 89 of the Constitution of the Republic of Azerbaijan and Articles 13.3, 19.4, 19.14, 28.2, 28.4 and 175.3 of Election Code of the Republic of Azerbaijan, Central Election Commission of the Republic of Azerbaijan decides:
1. Authorities of Mr. Azer Kamal oghlu Amiraslanov, Deputy of the third call Milli Majlis of the Republic of Azerbaijan elected on Shamkir city constituency # 98 in Parliamentary Elections conducted on November 6, 2005 shall be terminated.
2. The decision shall be enforced since the day of its publication.
