DECISION
of Central Election Commission
of the Republic of Azerbaijan

on the termination of the approved candidacy of  Mr. Suleyman Ughuz oghlu Guliyev in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008


Central Election Commission of the Republic of Azerbaijan (CEC) sent relevant inquiries to competent state bodies after conducting investigation pursuant to Election Code of the Republic of Azerbaijan related to the information submitted for the registration of the candidacy of Mr. Suleyman Ughuz oghlu Guliyev nominated on his own initiative in Presidential Elections of the Republic of Azerbaijan to be conducted on October 15, 2008. As the information obtained during the period determined by legislation caused bases for the approval of the candidacy, his candidacy was approved by Decision # 13/62 of session conducted by the CEC dated on August 18, 2008.
After the approval of the candidacy, it became known through the letter received from State Migration Service that Mr. Suleyman Ughuz oghlu Guliyev adopted citizenship of the Russian Federation in 1998 pursuant to the item # “A” of Article 18 of Federal Law of the Russian Federation dated on November 28, 1991 on “Citizenship of the Russian Federation”.
By conducting relevant investigation, CEC determined bases for the termination of the candidacy of Mr. Suleyman Ughuz oghlu Guliyev. As obvious, candidate intentionally concealed the information on possessing dual citizenship so that Article 100 of the Constitution of the Republic of Azerbaijan prohibits for the candidates to presidency of the Republic of Azerbaijan.
Pursuant to Article 13.3 of Election Code of the Republic of Azerbaijan, citizen of the Republic of Azerbaijan who possesses dual citizenship pursuant to Article 100 of the Constitution of the Republic of Azerbaijan shall not have the right to be elected (passive suffrage) as long as his/her dual citizenship remains.
Adopting the above-mentioned as a basis, pursuant to Article 100 of the Constitution of the Republic of Azerbaijan and Articles 13.3, 19.4, 19.14, 28.2 and 28.4 of Election Code of the Republic of Azerbaijan, Central Election Commission of the Republic of Azerbaijan decides:

1.  Candidacy of Mr. Suleyman Ughuz oghlu Guliyev, nominated on his own initiativeshall be terminated in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2008.
