DECISION
of Central Election Commission
of the Republic of Azerbaijan
on making relevant amendments to the “Instruction on the participation of stateless persons permanently living in the Republic of Azerbaijan in Presidential Elections of the Republic of Azerbaijan”
During the period while Election Code of the Republic of Azerbaijan has been in force by regulating election relations after its adoption on May 27, 2003, it has been made many appendixes and amendments because of the necessity of regulating election relations that have been developed speedily by Laws of the Republic of Azerbaijan dated on November 11, 2003, June 8, October 12 and December 30, 2004, March 4, June 14 and June 28, 2005, June 16, 2007 and June 2, 2008.
At the present, there caused necessity to adopt some instructions and make some appendixes, amendments to them related to some appendixes and amendments and to the legislation, necessity of regulating some relations, as well as improving base of normative acts for the preparation and conduct of elections (referendum).
Taking the above-mentioned as a basis and pursuant to Articles 19.4, 19.14, 25.3, 28.2 and 28.4 of Election Code of the Republic of Azerbaijan, CEC decides:
1. “Instruction on the participation of stateless persons permanently living in the Republic of Azerbaijan in Presidential Elections of the Republic of Azerbaijan” approved by Decision # 4/26 by CEC, dated on June 27, 2003 shall be made the following amendments and appendixes:
1.1. The 7th paragraph shall be excluded.
1.2. The 10th paragraph shall be edited as follows:
- “Aliens, stateless persons, foreign legal entities, their subsidiaries and representations are not allowed to participate in candidate nomination, their registration, election campaign of the registered candidates during elections. This does not restrict freedoms of opinion and collection of foreigners and stateless persons.
1.3. Relevant listing shall be in the Instruction.
2. Rules “on the distribution (deliverance) of notifications on informing the voters about the place and time of Elections to the Milli Majlis of the Republic of Azerbaijan” approved by Decision # 32/149 by the CEC, dated on October 5, 2005 shall be edited as follows (Decision # 14/67-2):
2.1. “Rules for the distribution (deliverance) of notifications on the place and time of the voting to the voters in elections (referendum) conducted in the Republic of Azerbaijan”.
3. This decision shall be enforced since the day of its publication.
