DECISION
of Central Election Commission
of the Republic of Azerbaijan
on making relevant amendments to the “Instruction on the rules for paying salaries to the Constituency and Precinct Election Commission members on Presidential Elections of the Republic of Azerbaijan”
During the period while Election Code of the Republic of Azerbaijan has been in force by regulating election relations after its adoption on May 27, 2003, it has been made many appendixes and amendments because of the necessity of regulating election relations that have been developed speedily by Laws of the Republic of Azerbaijan dated on November 11, 2003, June 8, October 12 and December 30, 2004, March 4, June 14 and June 28, 2005, June 16, 2007 and June 2, 2008.
At the present, there caused necessity to adopt some instructions and make some appendixes, amendments to them related to some appendixes and amendments and to the legislation, necessity of regulating some relations, as well as improving base of normative acts for the preparation and conduct of elections (referendum).
Taking the above-mentioned as a basis and pursuant to Articles 19.4, 19.14, 25.3, 28.2 and 28.4 of Election Code of the Republic of Azerbaijan, CEC decides:
1. “Instruction on the rules for paying salaries to the Constituency and Precinct Election Commission members on Presidential Elections of the Republic of Azerbaijan” approved by Decision # 4/28 by Central Election Commission of the Republic of Azerbaijan, dated on June 27, 2003 shall be made the following amendments (Decision # 12/57-1):
1.1. Word combination “on Presidential Elections of the Republic of Azerbaijan” shall be excluded from the title of the Instruction.
1.2. The words “at least 90 days up to” in the second paragraph of the Instruction shall be replaced by “at least 45 days up to”.
1.3. Words “at least 90 days up to” in the sixth paragraph of the Instruction shall be replaced by “at least 60 days up to”.
2. “Comment on the rules for early voting of voters” approved by Decision # 11/67 by Central Election Commission of the Republic of Azerbaijan, dated on July 12, 2003 shall made the following amendments and appendixes:
2.1. The title of the Comment shall be added words “in Presidential Elections of the Republic of Azerbaijan”.
2.2. The Comment shall be added the item # 1 at the following subject:
Pursuant to Article 104.4 of Election Code of the Republic of Azerbaijan, relevant Constituency Election Commissions can allow the conduct of voting at most 10 days up to the voting day in ships swimming under the state flag f the Republic of Azerbaijan and in areas having hard ways on the Election Day.
2.3. Item # 1.2. of the Comment shall be excluded.
2.4. Words “of envelopes” in items # 1.5. and 1.6. of the Comment shall be excluded and words “necessary amount” shall be replaced with words “necessary number”.
2.5. Row in the Comment shall be put in relevant succession.
3. “Instruction on the arrangement of elections in military divisions in Presidential Elections of the Republic of Azerbaijan appointed on October 15, 2003”, approved by Decision # 4/27 by Central Election Commission of the Republic of Azerbaijan, dated on June 27, 2003 shall be made the following amendments and appendixes (Decision # 12/57-3):
3.1. Word combination “appointed on October 15, 2003” in the title of the Instruction shall be excluded.
3.2. Word combination “in period defined by Article 35.2 of Election Code” in the second paragraph of item # 1 of the Instruction shall be replaced by “at least 50 days up to the voting day”.
3.3. The first sentence of item # 2 of the Instruction shall be made the following amendment:
Military servants of military divisions whose voting in general precincts is impossible based on the presentation by military servants of frontier army and military servants located in zones of military conflicts, as well as relevant executive authorities, they shall vote in precincts established in military divisions.
3.4. The following sentence shall be added to the end of the sixth item of the Instruction:
Voters’ lists shall be compiled in 2 copies. The information on the voters included in the voters’ list shall be located in the alphabetical order in the list. The lists should contain voter’s surname, name, patronymic, date of birth, address of residence and number of precinct.
4. This decision shall be enforced since the day of its publication.
