DECISION
of Central Election Commission
of the Republic of Azerbaijan on the declaration of Presidential Day of the Republic of Azerbaijan
According to Articles 100-102 of the Constitution of the Republic of Azerbaijan, bases of Presidential Elections of the Republic of Azerbaijan and according to Election Code of the Republic of Azerbaijan, the period and rule of the appointment of elections shall determined.
According to Article 101.1 of the Constitution, President of the Republic of Azerbaijan shall be elected for 5 years by independent, personal and secret voting via general, equal and direct suffrage.
According to Article 178.1 of Election Code of the Republic of Azerbaijan, Wednesday of the third week in October of the past year when President’s term of authority ends, shall be considered as Election Day.
Presidential Elections of the Republic of Azerbaijan were conducted on October 15, 2003, at the present as the last year of President’s authority for 5 years, there caused reason to appoint new elections.
According to Article 178.2 of Election Code of the Republic of Azerbaijan, the day of conducting Presidential Elections of the Republic of Azerbaijan shall be declared by CEC decision. According to Article 178.3 of the Code, CEC decision on the declaration of the day of conducting elections shall be published at latest within 2 days.
Taking the above-mentioned as a basis, according to Articles 100-102 of the Constitution of the Republic of Azerbaijan, Articles 19.4, 19.14, 28.2, 28.4, 177, 178.2 and 178.3 of Election Code of the Republic of Azerbaijan, CEC decides:
- 15 October 2008 shall be declared the day of Presidential Elections of the Republic of Azerbaijan.
- The decision shall be published at latest within 2 days since the day of its adoption.
- The decision shall be enforced since the day of its publication.
