INSTRUCTION
on the usage of the State Automated Information
System during elections (Referenda)
1. Rules for
the usage of the State Automated Information
System (SAIS) during elections of deputies of
the Milli Majlis of the Republic of Azerbaijan,
Presidential Elections of the Republic of Azerbaijan,
Municipal Elections of the Republic of Azerbaijan
and Referenda of the Republic of Azerbaijan
shall be defined by Article 110 of the Election
Code of the Republic of Azerbaijan.
2. The SAIS can be used in getting, conveying
and re-preparation of the information while
conducting elections, as well as registering
voters, compiling voters lists: defining voting
results and election returns.
3. “Sechkiler” Information Center under the
Central Election Commission of the Republic
of Azerbaijan implements the functions of the
SAIS. In Constituency and Precinct Election
Commissions, these duties are implemented by
computer operator (operators) administration
“Sechkiler” Information Center.
4. Single voters list for the Republic of Azerbaijan
shall be compiled by the Central Election Commission
using the SAIS pursuant to Articles 46.11 and 46.12 of Election Code of the Republic of Azerbaijan. The state guarantees in the
dissemination of the information on the voters
included in the SAIS and “Sechkiler” Information
Center is responsible for not dissemination
of the information.
5. The relevant election commission establishes
supervision group of the election commission
by its decision in order to control on the usage
of the SAIS and its separate technical means.
The supervision group inspects the readiness
of the automated complexes to the work, accuracy
of the information excluded from the protocols
of election commissions and given to the system,
as well as the information attached to the protocols
and controls the observance of the requirements
of the Election Code of the Republic of Azerbaijan,
the Instruction and other normative documents,
documentation of the implied activities to use
the SAIS according to the Regulation and the
Calendar Plan by the relevant election commission.
The supervision group can involve specialists
in the field of the automated information system
to its work.
6. Members of the supervision group shall have
the following rights:
• be aware of any information delivered to the
relevant election commission via technical communication
means;
• require a comment on the technical documentation
of the SAIS and actions the technical staff
of the system;
• compare the information prepared manually
and via technical means;
• to report to the chairman of the election
commission on one of the personnel of the system
or observers if their actions are contrary to
the law and make proposals on elimination of
these violations or dismissal of the persons
who violated.
Results of the inspection conducted by the supervision
group should be indicated in the current documents
of the relevant election commission.
7. All members of the election commissions,
observers, representatives of mass media shall
have the right to be aware of any information
included in and excluded from the SAIS under
the condition of not hindering the work of operators
and respecting everyone’s right to personal
inviolability.
8. After the voting begins, the relevant election
commissions use the SAIS to observe the voting
procedure and results based on the information
of lower election commissions conveyed to upper
election commissions till the protocols of election
commissions on election returns and voting results
are signed. During this period, to deliver any
information excluding the signals that approves
the reception of the information conveyed to
information services of lower election commissions
by information services of upper election commissions
shall be prohibited.
9. The supervision group shall submit the information
on the voting procedure and election results
to the SAIS according to the report hours defined
by the Central Election Commission by considering
the voting of voters with increasing finals.
The information can be conveyed part by part
according to the same report hours.
10. The information on the voting procedure
and its results got via the SAIS is considered
the primary information bearing legal importance.
11. The information got by election commissions
shall be included in the computer immediately
and submitted to the supervision group for official
approval according to the form attached to the
Instruction. After the members of the supervision
group and persons responsible for the preparation
(conveyance) of the information approve the
accuracy by their signatures, the information
should be conveyed to “Sechkiler” Information
Center.
12. The texts of the information included in
the SAIS published via computer should be attached
to the protocol of the election commission preserved
in the secretariat of the election commission.
