I N S T R U C T I O N
on the working rules with voters lists of Constituency
and Precinct Election Commissions
Correct compliance
of voters lists and their submission to make
aware everyone of these are an important guarantee
for citizens of the Republic of Azerbaijan to
enjoy their own rights to vote freely.
- Permanent voters lists shall be approved by
the Precinct Election Commission (PEC) on each
polling station in the form defined by Central
Election Commission of the Republic of Azerbaijan
(hereafter referred to as Central Election Commission)
till May 30 of evry year and shall be specified at least
35 days prior to the voting day.
- According to the inquiry of each citizen,
the relevant election commission shall report
on his/her inclusion in the voters list.
- Voters lists should be compiled in 2 copies.
The information on included voters should be
located in the list in the alphabetical order
or in other order (on settlements, streets,
apartments, buildings). Lists should contain
name, surname, patronymic, date of birth (for
the people aged 18 –including birth month and
day), address of permanent residence (number
of street, apartment and flat, if it its temporary
residence-address of the hospital, sanatorium,
rest home and other places) of the voter and
number of polling station.
First copy of the primary voters list compiled
on the polling station shall be preserved in
the PEC by compiling relevant act, the second
copy shall be submitted to the Constituency
Election Commission (Con.EC) not later than
February 5 each year, but at least 25 days prior
to the voting day. Voters lists on polling stations
shall be signed by the chairman and secretaries
of the PEC and verified by the seal of the commission.
Primary voters lists on the constituency should
be compiled in 2 copies not later than March
5 each year and signed by the chairman and secretaries
of the Con.EC and submitted to the Central Election
Commission till April 5 after being verified
by the seal of the election commission.
If incompatibilities are reveled in voters lists
by Central Election Commission, then amendments
are made to them and then, are approved by PECs
and Con.ECS till May 25. Voters lists on the
republic of Azerbaijan shall be compiled by
Central Election Commission via the state automated
information system.
After the specification of voters lists the
PEC checks and considers amendments made and
are to be made according to personal appeals
of citizens, as well as investigates them according
to relevant documents submitted by officials,
municipalities, authorities on state registration
of civil condition acts, authorities on
Registration of civil residences or places settled
by citizens.
- Single voters lists shall be managed by Central
Election Commission.
- Each year the information on the specification
of voters lists shall be submitted to Central
Election Commission by Con.Ec of PECs.
- Single voters lists shall be conducted on
constituencies, polling stations and on the
whole the Republic of Azerbaijan.
- The information on voters lists approved by
PECs of polling stations formed outside the
borders of the Republic of Azerbaijan is not
included in single voters lists. This information
shall be submitted by Central Election Commission
in the case defined by it and gathered together
in temporary voters lists. Temporary voters
lists shall be attached to single voters lists.
- The information on voters with active suffrage
submitted by relevant executive authorities
and heads of municipalities and commanders of
military units shall be included in permanent
voters lists.
- The information on voters with active suffrage
submitted by heads of consulate departments
and diplomatic delegates, as well as heads of
institutions temporarily settled by voters shall
be included in temporary voters lists.
- If voters lists on polling stations established
in remote districts are compiled by PECs according
to the information on voters submitted by heads
of relevant executive authorities and municipalities
at least 25 days prior to the voting day, and
polling stations are established 5 days prior
to the voting day, then voters lists shall be
specified 2 days after the establishment of
the PEC.
- If any polling station is not established
in the military unit, the commander of the military
unit and heads of institutions of confinement
shall collect and specify the information on
voters in the case defined by Central Election
Commission and if not any other case is implied
by the Election Code of the Republic of Azerbaijan
(hereafter referred to as the Election Code),
they submit this information to the relevant
PEC at least 35 days prior to the voting day.
- All citizens with active suffrage shall be
included in voters lists.
- In order to include the citizen in the voters
list on the polling station, the fact that this
citizen lives permanently in the area of the
relevant polling station defined by the authority
on the registration of his/her residence or
place settled by him/her (that he/she lives
in the area of the polling station within 6
months of early 12 months after the declaration
of elections) shall be adopted as a basis.
- After the distribution of voting cards and
making aware of voters lists, voters settled
in the area of the polling station and were
not included in lists for some reasons shall
be included in voters lists by the PEC according to their
ID cards or its substitute documents, if necessary,
the documents proving that the voter lived more
in the area of this polling station.
- The voter can be included in voters lists
on only one polling station. If the election
commission finds out that the voter has been
included in voters list in more than one polling
stations, then it shall investigate its reasons
and ensure inclusion of the voter in one list.
- After the approval of voters lists, a citizen
is excluded from voters lists according to official
documents, as well as to the voting card provided
to the voter pursuant to Article 101 of the
Election Code and the voter is informed of this
by letter. In this case, the voters list should
contain the date and reason of exclusion of
the citizen. This fact shall be approved by
the sign of the chairman and secretaries of
the PEC and upon providing with de-registration
cards for the voting, the card shall be approved
by the sign of the provided election commission.
- The PEC shall submit voters lists to make
aware voters of these and make additional specifications
at least 65 days prior to the voting day by
informing voters of this and offer necessary
facilities for this. Voters lists should be
located in badges outside the voting room, in
places comfortable for motion and well-seen
by voters 25 days prior to the voting day. In
this case, the number of residences and apartments
of citizens should be indicated.
