DECISION
of Central Election Commission
of the Republic of Azerbaijan on adding the following document forms to Comment “on the rule for the completion of final protocol on the voting results on the municipality compiled by Constituency Election Commission in Municipal Elections of the Republic of Azerbaijan”
Pursuant to Articles 19.4, 19.14, 25.3, 28.2 and 28.4 of Election Code of the Republic of Azerbaijan, CEC decides:
I. The following document forms shall be added to Comment “on the rule for the completion of the final protocol on the voting results on the municipality compiled by Constituency Election Commission in Municipal Elections of the Republic of Azerbaijan”, approved by decision # 22/147 adopted by Central Election Commission, dated on October 8, 2004:
1. Act “on providing Constituency Election Commission with ballot papers and envelopes by Central Election Commission for the voting in Municipal Elections conducted in the Republic of Azerbaijan”, approved by Decision # 15/92 adopted by Central Election Commission, dated on August 25, 2004 – as an Appendice # 1;
2. The sample of Act “on the cancel of unused ballot papers in Municipal Elections conducted in the Republic of Azerbaijan” – as an Appendice # 2 by being approved;
3. The sample of Act “on the issuance of de-registration (voting) cards for voting and cancel of unused cards in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 3 by being approved;
4. The sample of Act “on the number of unused envelopes on the voting day in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 4 by being approved;
5. The sample of Reference “on providing Central Election Commission with final election documents by Constituency Election Commission in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 5 by being approved;
II. The last 3 paragraphs of the Comment shall be edited as follows:
It shall be prohibited for commissioners to sign incomplete or partially completed protocol. The member of the Precinct Election Commission who does not agree with the protocol in whole or its separate parts, can add his/her special opinion to the protocol. In this case, he/she shall not sign the protocol.
If the territory of the municipality covers the territories of some constituencies, then the voting results on these municipalities shall be settled according to the rules defined by CEC.
By being attached, the first copy of Con.EC protocol, final tabulation on the voting results on the constituency, as well as complaints (applications) on the violation of Election Code received by the Con.EC on the voting day and decisions on these adopted by the Con.EC (if there are not such complaints, then the Act by the Con.EC), Act on reception of envelopes and ballot papers by the Con.EC (Appendice # 1), Act on the cancel of ballot papers (by indicating the number of such ballot papers) (Appendice # 2), Act on the issuance of voting cards and the cancel of unused voting cards (by indicating the number of these cards) (Appendice # 3), Act “on the number of unused envelopes on the voting day in Municipal Elections conducted in the Republic of Azerbaijan” (Appendice # 4) shall be immediately, but not later than 2 days after the voting day sent to Central Election Commission by the accompany of the Con.EC chairman and members representing different political parties.
III. The latest paragraph at the following subject shall be added to the Comment:
Central Election Commission shall provide the Con.EC Chairman who submitted the documents with Reference “on the submission of final election documents to Central Election Commission by the Con.EC in Municipal Elections in the Republic of Azerbaijan” (Appendice # 5).
