DECISION
of Central Election Commission
of the Republic of Azerbaijan

on adding the following document forms to Comment “on the rules for the completion of final protocol on vote counting in the precinct and voting results compiled by Precinct Election Commission in Municipal Elections of the Republic of Azerbaijan”

Pursuant to Articles 19.4, 19.14, 25.3, 28.2 and 28.4 of Election Code of the Republic of Azerbaijan, CEC decides:
I. The following document forms shall be added to Comment “on the rule for the completion of the final protocol on vote counting in the precinct and voting results compiled by Precinct Election Commission in Municipal Elections of the Republic of Azerbaijan”, approved by decision # 22/146 adopted by Central Election Commission, dated on October 8, 2004:
1. Act “on providing Precinct Election Commission with ballot papers and envelopes by Central Election Commission in Municipal Elections conducted in the Republic of Azerbaijan”, approved by Decision # 15/92 adopted by Central Election Commission, dated on August 25, 2004 – as an Appendice # 1;
2. The Act “on the cancel of unused ballot papers before opening ballot boxes  on the voting day in Municipal Elections conducted in the Republic of Azerbaijan” – as an Appendice # 2;
3. The sample of Act “on the issuance of de-registration (voting) cards for voting and cancel of unused cards in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 3 by being approved;
4. The sample of Act “on the number of the cut left corners of the ballot papers in Municipal Elections conducted in the Republic of Azerbaijan”, approved by decision # 15/92 adopted by Central Election Commission, dated on August 25, 2004 as an Appendice # 4;
5. The Act “on the cancel of the ballot papers spoilt because of the mistake made by the citizens on the voting day in Municipal Elections conducted in the Republic of Azerbaijan”, approved by decision # 15/92 adopted by Central Election Commission, dated on August 25, 2004 as an Appendice # 5;
6. The Appendice # 1 “on the number of the ballot papers taken in regard with the applications of the voters for voting outside of the voting room, the ballot papers used and returned without being used”, made to Comment approved by decision # 22/146 adopted by Central Election Commission, dated on October 7, 2004 as an Appendice # 5;
7. The sample of Act “on the number of unused envelopes on the voting day in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 7 by being approved.
8. The Reference “on providing the Con.EC with final election documents by PEC in Municipal Elections conducted in the Republic of Azerbaijan” as an Appendice # 8 by being approved.

II. The following document samples shall be considered invalid:
1. Act “on the cancel of unused de-registration (voting) cards in Municipal Elections conducted in the Republic of Azerbaijan”, approved by decision # 15/92 adopted by Central Election Commission dated on August 25, 2004;
2. Act “on providing Con.EC with election documents by PEC related to Municipal Elections”, approved by decision # 15/92 adopted by Central Election Commission dated on August 25, 2004.

III. The last  paragraph of the Comment shall be edited as follows:
By being attached, the first copy of the protocol, complaints (applications) on the violation of Election Code received by the PEC on the voting day and decisions on these adopted by the PEC, Act on reception of ballot papers by the PEC (Appendice # 1), Act on the cancel of unused ballot papers (Appendice # 2), Act on the issuance of voting cards and the cancel of unused voting cards (Appendice # 3),  Act on the number of the cut left corners of the ballot papers, Act on the cancel of the ballot papers spoilt because of the mistake made by the voting citizens,   Act on the number of closed and stamped envelopes, the ballot papers taken in regard with the applications of the voters for voting outside of the voting room, the ballot papers used and returned without being used,  Act on the number of unused envelopes on the voting day, closed and stamped envelopes, ballot papers, list of voters on the precinct shall be immediately, but not later than 24 hours sent to Constituency Election Commission by the accompany of the PEC chairman and two members representing different political parties. The above-mentioned acts shall be signed by PEC Chairman and Secretaries. Copies of the complaints (applications), PEC decisions and the above-mentioned acts shall be attached to the second copy of the protocol.

IV. The latest paragraph at the following subject shall be added to the Comment:
Constituency Election Commission shall provide the PEC Chairman who submitted the documents with Reference “on the submission of final election documents to Constituency Election Commission by the Precinct Election Commission in Municipal Elections in the Republic of Azerbaijan” (Appendice # 8).
