INSTRUCTION
on marking the fingers of voters who got ballot
papers with invisible ink on the voting day
in third call Elections to the Milli Majlis
of the Republic of Azerbaijan to be conducted
on November 6, 2005
1. The Instruction
shall define the rules for marking the fingers
of voters with invisible when they get ballot
papers and for discovering of this ink pursuant
to recommendations for Central Election Commission
by the Order of President of the Republic of
Azerbaijan “on urgent activities related to
the preparation and conduct of Elections to
the Milli Majlis of the Republic of Azerbaijan”
dated on October 25, 2005.
2. While getting ballot papers on the voting
day, Precinct Election Commissions (PECs) shall
mark the voters’ fingers with specific and not
harmful liquid ink. A voter’s finger shall be
inked by spraying. In order to discover the
ink on the voter’s finger, an ultra-violet lamp
shall be used.
3. In the aim mentioned in the item # 2 of the
Instruction, each polling station shall be provided
with one ultra-violet lamp an a set of spare
batteries and by considering the number of voters,
for 500 persons one spray ink bottle, for 1000
persons 2 spray ink bottles and for 1500 persons
3 spray ink bottles. These supplies shall be
provided to the chairmen of Constituency Election
Commissions (Con.ECs) by compiling an act.
4. Con.EC Chairman shall provide the PEC with
ink bottles, ultra-violet lamps and batteries
in the usable state implied by items # 3 of
the Instruction at latest within 2 days prior
to the voting day by compiling an act.
Safe protection of ink applicators and UV lamps
shall be ensured at Con.ECs and PECs. The relevant
PEC chairman shall personally carry responsibility
for the usage and protection of these supplies
only in the aims defined by the Instruction.
5. The persons implied by Articles 40.2 and
40.4 of Election Code of the Republic of Azerbaijan
and representatives of mass media can observe
the process of marking the voter’s finger with
invisible ink and its checking.
6. Ink applicator and UV lamp shall be checked
by the observation of observers and before opening
the polling station. If any one or all of the
supplies are not in usable state and the prevention
of shortcomings is impossible, then commissioners
shall compile an act on these and immediately
inform the Con.EC. The Con.EC Chairman shall
provide this PEC with new supplies without delay.
These supplies shall be preserved in the voting
room.
7. In the case defined by Instruction “on the
working rule for Precinct Election Commissions
on the voting day” approved by Central Election
Commission, election commissioner who meets
voters coming to the polling station on the
voting day firstly shall check existence of
invisible ink on the voter’s finger. The commissioner
shall keep the lamp at a 2-3 centimeters distance
from the finger, apart from the bright light.
If the inking of the finger is discovered, then
election commissioner shall ask the voter to
leave the polling station. This member of the
PEC shall allow the voter on whose finger the
ink stain has not been discovered.
8. Election commissioner responsible for issuance
of ballot papers to the voters, shall check
ID card or its substitute document of the voter
and after being sure of inclusion of the name
in the voters list, he shall spray invisible
ink on the voter’s left thumbnail and a part
of skin before the voter signs in the voters
list. If the voter does not have this finger,
then his/her next finger, if does not have left
hand, then thumbnail of right hand shall be
inked (if the voter does not have right thumb,
another rule above-mentioned shall be applied).
Election commissioner shall be sure of inking
of the voter’s nail and cuticle.
Election commissioner shall ask the voter to
wait until the ink dries and not to touch that
finger.
9. The voter who refuses from inking of his
finger shall be explained of the impossibility
of his/her voting. If the voter does not agree,
then he/she shall be asked to leave the precinct.
The relevant words - “Refusal from ink” shall
be noted in the voters list.
10. When using mobile ballot boxes, the voter’s
finger shall not be inked during the voting.
