INSTRUCTION
on the rule for the registration of the political
party bloc, nomination of candidates by political
parties and political party blocs
I. For the registration
of political party bloc pursuant to Article
50 of Election Code of the Republic of Azerbaijan,
its authorized representative shall provide
Central Election Commission with the following
documents in the form pursuant to Election Code
of the Republic of Azerbaijan;
1. copies of powers of attorney of political
parties entering bloc approved in the notary
order;
2. agreement of political parties on entering
bloc;
3. decisions of political parties on entering
bloc;
4. joint decision of political parties on establishment
of bloc, signed by authorized representatives
and verified by stamp;
5. information about the whole and short name
of political party blocs;
(The name of the political party bloc shall
be determined at joint session of parties` representatives
regardless of the participation of political
parties not entering this bloc when naming the
bloc in elections), the names of political parties
previously participated in elections should
not be used. If recently registered political
parties don`t include more than half of political
parties that established this bloc in previous
elections, then recently established bloc should
not be named as the previous political party
bloc. The surname of physical person should
be used by the political party bloc only on
the basis of the written consent of this person.
6. The political party bloc can provide Central
Election Commission with its emblem for approval.
(excluding registered emblem of the political
party bloc, of any political party included
in it or emblems used by political parties or
the political party bloc intoday`s and previous
elections)(by considering Article 51.2 of the
Code),any emblem can be submitted. Emblems of
the political party bloc should not violate
the rights to intellectual property, assets,
offend national and religious symbols of the
Republic of Azerbaijan, violate generally accepted
ethics norms. The political party bloc shall
come to agreement with Central Election Commission
to use the name consisting not more than five
words and emblem in election documents).
7. decision of joint session of authorized representatives
of political parties, the political party bloc
on the appointment of authorized representatives,
as well as authorized representatives on financial
issues or their conference, decision of the
conference or leading body;
8. list of authorized representatives (Appendice
# 2), (authorized representatives on financial
issues) (Appendice # 3);
9. written letters of these persons their consent
to be authorized representative (Appendice #
4 and 5).
(Authority of the representative can be terminated
by warning in written form by the decision of
political parties, the political party bloc;
Copy of the decision related to it shall be
sent to Central Election Commission and Constituency
Election Commission).
The authorized representative shall be provided
with written reference on getting documents
submitted to Constituency Election Commission
(in the form approved by Decision # 07/52 of
Central Election Commission dated on July 2,
2004, Appendice # 7).
II. Political party adopts decision on candidate
nomination according to its charter. Such decision
shall be adopted in collegial form via voting.
Candidate nominated by the political party bloc
shall be approved by each political party entering
bloc. Decision on the nomination of candidates
by the political party bloc shall be adopted
at the session of political party representatives
(in conferences, session of leading body). These
authorized representatives of political parties
shall be determined at the conference of parties
(conference, session of the leading body).
Decision of political parties, the political
party bloc on nomination of the candidate shall
be made official by the protocol. This protocol
should contain:
a) the number of registered participants at
session (conference, session of the leading
body);
b) the number of participants necessary for
the adoption of the decision considered by the
agreement on the establishment of the political
party bloc;
c) decision on the candidate nomination and
voting results on this decision;
d) date of adoption of the decision.
Political parties, the political party bloc
can nominate persons not being members of parties
that do not enter the bloc.
Candidate or candidates can be nominated by
political parties only in the case when the
following documents shall be submitted to the
relevant Constituency Election Commission together
with the name of the candidate by authorized
representatives of political parties pursuant
to Election Code of the Republic of Azerbaijan
and this Instruction:
1. copy of the certification on the registration
of political parties approved in the notary
order;
2. copy of the charter of the political party
approved in the notary order;
3. decision of the conference (conference, session
of the leading body) of the political party
on candidate nomination and relevant session
minutes;
4. application on consent of the nominated candidate
that contains information about his/her liability
and citizenship, as well as commitment on termination
of the activity inappropriate with the duty
when elected deputy (Appendice # 1);
5. decision of the convention (conference, session
of the leading body) of the political party
on the appointment of authorized representatives,
as well as authorized representatives on financial
issues;
6. powers of attorney of authorized representatives
and authorized representatives on financial
issues of political parties made official in
notary order (Appendices # 6 and 6 “A”);
7. list of authorized representatives of political
parties (Appendice # 2);
8. when authorized body of political parties
terminates the authority of the authorized representative,
then the copy of the decision on it.
The authorized representative
shall be provided with the written reference
on getting documents submitted to the Constituency
Election Commission (in the form approved by
Decision # 07/52 of Central Election Commission
dated on July 2, 2004, Appendice # 7).
Central Election
Commission shall be provided with the following
documents by political parties:
1. list of authorized representatives of political
parties (Appendice # 2);
2. list of authorized representatives on financial
issues (Appendice # 3);
3. letters on consent of authorized representatives
(Appendice # 4);
4. letters on consent of the authorized representative
on financial issues (Appendice # 5).
The candidate or
candidates shall be nominated by the political
party bloc in the case the relevant Constituency
Election Commission is provided with the following
documents together with the name of the candidate
pursuant to Election Code of the Republic of
Azerbaijan and this Instruction.
1. session minutes of political parties that
enter bloc together with decisions of conventions
(conferences, session of the leading body) on
candidate nomination.
2. decision of the session (convention, conference)
of representatives of political parties that
enter bloc on candidate nomination in the name
of the political party bloc relevant session
minutes.
3. powers of attorney of authorized representatives
and authorized representatives on financial
issues of the political party bloc made official
in notary order (Appendices # 6 and 6”A”).
4. list of authorized representatives of the
political party bloc (Appendice # 2).
5. application on consent of the nominated candidate
that contains information about his/her liability
and citizenship, as well as commitment on termination
of the activity inappropriate with the duty
when elected deputy (Appendice # 1);
The authorized
representative shall be provided with the written
reference on getting documents submitted to
the Constituency Election Commission (in the
form approved by Decision # 07/52 of Central
Election Commission dated on July 2, 2004, Appendice
# 7).
