I N S T R
U C T I O N
on rules for transference and return of voluntary
registration deposits
1. Rules for transference
and return of voluntary registration deposits
shall be regulated by Articles 58.5, 60.5, 73.2
and 156.1 of the Election Code of the Republic
of Azerbaijan and this Instruction.
1.1. While submitting signature sheets and other
documents for registration of the candidate
to the Milli Majlis of the Republic of Azerbaijan
(hereafter referred to as the candidate to deputy),
at the same time a bank document can be submitted
on transference of voluntary registration deposit
to the account of the relevant Constituency
Election Commission amounted 3 % of the 75000
conditional financial unit defined by Article
58.5 of Election Code, i.e. of the maximum limit
of the candidate`s election fund defined for
the day of official publication of the decision
on the appointment of elections pursuant to
Article 156.1 of Election Code. This document
should contain the destination of payment, i.e.
words of “for registration deposit”.
1.2. Election fund of the candidate to deputy,
political parties, blocs of political parties
can not be used while transferring of voluntary
registration deposit to bank account of the
Constituency Election Commission that implements
registration.
2. If the candidate to deputy is not registered,
then within 3 days after getting the copy of
the decision on refusal from the registration
of the candidacy, the leading authority of the
candidate, political party (blocs of political
parties) that nominate the candidate, session
of authorized representatives of political parties
can appeal on registration of the candidate
by the relevant Constituency Election Commission
(by indicating name, surname, patronymic, serial
number of identification card of the candidate,
date and number of the decision on refusal from
the candidacy) providing that not to return
voluntary registration deposit.
2.1. In this case, the Constituency Election
Commission registers the candidate to deputy
within 2 days. In all other cases, voluntary
registration deposit shall be returned to the
candidate, the candidate, political party, blocs
of political parties that nominate the candidate
within 3 days after adoption of the relevant
decision on registration and refusal from registration
by the Constituency Election Commission.
2.2. If the candidate to deputy is elected deputy
and gains at least 3 percent of valid votes,
registration deposit shall be returned to the
former candidate to deputy nominated by the
relevant Constituency Election Commission within
3 days after official publication of election
results.
2.3. If the registered candidate to deputy withdrawals
his/her candidacy without any obligatory cause
(serious illness of the registered candidate
approved by the relevant medical expertise specified
by the Labor Code of the Republic of Azerbaijan
and regarding incapability to function by the
court, or health disorder of the candidate to
deputy during election campaign as a result
of reasons that makes impossible his/her participation),
then the voluntary registration deposit shall
not be returned.
Note: Registration
deposit can be basis for registration of the
candidate only when the number of valid signatures
collected in support of the candidate is not
sufficient for the registration defined by item
# 2.1 of this Instruction.
