. : INSTRUCTIONS (MUNICIPAL ELECTION-2004)

INSTRUCTION

on rules for the establishment of voters initiative groups and candidate nomination in Municipal Elections of the Republic of Azerbaijan

1. During Municipal Elections in the Republic of Azerbaijan candidate nomination shall be regulated by Articles 53, 54 and 214 of the Election Code of the Republic of Azerbaijan
2. In the case implied by Article 215 of the Election Code of the Republic of Azerbaijan, compared with population number, the voters initiative group consisting of not less than
30 persons - in the municipality whose population is more than 99.999,
25 persons - in the municipality whose population is more than 49.999,
20 persons - in the municipality whose population is more than 19.999,
15 persons - in the municipality whose population is more than 9.999,
10 persons - in the municipality whose population is more than 4.999,
5 persons - in the municipality whose population is less than 4.999,
shall be established.
3. The fact that members of voters initiative groups live within the territory of the relevant municipality shall be taken as basis.
4. Candidate or candidates can be nominated by voters initiative group consisting of citizens with active suffrage only in the case when the following documents are submitted to the relevant Constituency Election Commission (Con.EC) in the form defined by this Instruction.
5. In order to nominate candidate or candidates to municipality membership a meeting shall be conducted by voters intending to establish initiative group.
5.1. Before the meeting, voters intending to establish initiative group shall be informed about the place and time of the meeting.
5.1.1. The following issues shall be discussed in this meeting:
5.1.2. Establishment of voters initiative group in the case meeting requirements of item # 2 of the Instruction, consisting of this number or more;
5.1.3. Nomination of candidates less or the same number as the number of the candidate or municipality members;
5.1.4. Apply to the Con.EC with notification for the approval of the candidate nomination.
5.2. The above-mentioned issues are discussed in the meeting of voters initiative group, decisions are adopted and relevant protocol is compiled on this. This protocol shall be signed by the chair and secretary of the meeting.
5.3. Protocol of the meeting of voters initiative group and each page of the notification shall be approved by the stamp of the municipality within the territory where the meeting has been conducted, executive representation, communal services and other legal entities.
6. The following documents compiled in accordance with Article 53 of the Election Code of the Republic of Azerbaijan and the Instruction shall be sent to the relevant Con.ECs:
1) protocol of the meeting on the establishment of voters initiative group (Appendice # 4 to the Instruction);
2) separately compiled notification on the initiative to nominate each candidate (Appendice 1”A” to the Instruction);
3) application on consent of the candidate or candidates compiled pursuant to Article 53 of the Election Code of the Republic of Azerbaijan and approved in the notary order (Appendice 2”A” to the Instruction);
If an authorized representative is appointed by the candidate or candidates:
4) application on consent of the authorized representative or representatives (this application shall be approved in the notary order). (Appendice # 3 to the Instruction);
5) powers of attorney of the authorized representative given by the candidate and approved in the notary order.

7. The citizen who nominated his/her candidacy to municipality membership on his/her own initiative shall provide the Con.EC with the following documents:
1) notification on the nomination of the candidate to municipality membership (Appendice # 1 to the Instruction);
2) application on commitment of the candidate or candidates compiled pursuant to Article 53 of the Election Code of the Republic of Azerbaijan and approved in the notary order (Appendice 2 “A” to the Instruction).
If the authorized representative has been appointed:
3) application on consent of the authorized representative or representatives approved in the notary order (Appendice #3 to the Instruction);
4) powers of attorney of the authorized representative or representatives given by the candidate to municipality and approved in the notary order.

8. Political parties can nominate candidate or candidates only in the case when the following documents shall be submitted to the relevant Con.EC in the form pursuant to the Election Code of the Republic of Azerbaijan and this Instruction:
1) copy of the certified document on the registration of the political party that has been approved in the notary order;
2) copy of empowered regulations of the political party that has been approved in the notary order;
3) decision of convention by the political party (conference, meeting of authoritative body) on the candidate nomination and protocol of the relevant meeting;
4) list of political parties, authorized representatives (this list shall also be submitted to the Central Election Commission) (Appendice 4 “A” to the Instruction). Also list of authorized representatives on financial issues;
5) authorized representative’s letter on consent (Appendice # 3 to the Instruction)
6) powers of attorney of authorized representatives of political parties made official in the notary order;
7) notification on the nomination of the candidate to municipality membership (Appendice # 1 to the Instruction);
8) candidate`s letter on consent (Appendice 2 “A” to the Instruction);

9. For the registration of the political party pursuant to Article 50 of the Election Code of the Republic of Azerbaijan, its authorized representative shall provide the Central Election Commission in the form defined by the Election Code of the Republic of Azerbaijan:
1) copies of regulations of political parties entering blocks, that has been approved in the notary order;
2) decisions by political parties on entering the block;
3) joint decision on the establishment of the block, signed by authorized representatives of political parties and approved by the stamps of these political parties.

10. Blocks of political parties can nominate candidate or candidates only in the case when the following documents are submitted to the relevant Con.EC pursuant to the Election Code of the Republic of Azerbaijan and this Instruction;
1) decision of the meeting (convention, conference) of representatives of political parties entering blocks, on candidate nomination on behalf of political parties and protocol of the relevant meeting;
2) powers of attorney of authorized representatives of political party blocks that has been made official in the notary order;
3) list of authorized representatives of political party blocks. This list shall also be submitted to the Central Election Commission (It shall be Appendice # 4 to the Instruction). Also list of authorized representatives on financial issues;
4) authorized representatives` letter on consent (Appendice 3 “A” to the Instruction);
5) notification on candidate nomination to municipality membership (Appendice #1 to the Instruction);
6) candidate’s application on consent (Appendice 2 “A” to the Instruction);
