INSTRUCTION
on establishment of initiative
groups and rules for candidate nomination on
citizens` initiative or voters initiative during
Elections to the Milli Majlis of the Republic
of Azerbaijan
1.1. During Elections
to the Milli Majlis of the Republic of Azerbaijan,
candidate nomination shall be regulated by Articles
53 and 146 of the Election Code of the Republic
of Azerbaijan.
1.2. During re-elections on the constituency,
candidates shall be nominated after the official
publication of the decision on appointment of
these elections.
1.3. During by-elections, candidates shall be
nominated after the period noted by Article145.4
of the Election Code of the Republic of Azerbaijan,
i.e. within 2 days after the official publication
of the decision on appointment of elections
in mass media.
1.4. Each citizen or citizens with voting rights
can form voters initiative groups consisting
of 50 persons to nominate candidates to the
Milli Majlis.
2. Candidate can be nominated on his/her own
initiative or by citizens with active voting
rights in the case when the following documents
shall be submitted to the relevant Constituency
Election Commission (Con.EC) in accordance with
the samples added to this Instruction.
3. Candidate or voters initiative group nominating
candidate shall provide the Con.EC with written
notification on his/her own initiative. The
notification should contain the surname, name,
patronymic, date of birth, address of residence,
serial number of ID card or its substitute document
of each initiator or candidate, besides, it
should contain major job or service place, his
position (if not any then kind of activity).
4. A meeting is held by voters with the intend
to establish initiative group in order to nominate
candidate. Before the meeting, voters intending
to establish initiative group shall be infirmed
of the place and time of the meeting. The fact
of territorial units of the relevant constituencies
settled by members of initiative groups is taken
as basis.
4.1. The following issues are discussed in the
meeting:
- establishment of voters initiative groups
consisting of at least 50 persons;
- nomination of the candidate
- registration of voters as initiative group
and to apply to the Con.EC for the decision
on the registration of the nominated candidate.
4.2. Decisions are adopted by discussing the
above-stated issues in the meeting of voters
initiative group and the protocol is compiled.
This protocol is signed by the chair and secretary
of the meeting.
4.3. If the meeting is held in some institution,
office or organization, then the protocol of
the meeting of voters initiative group and each
page of the notification shall be approved by
the stamp of these organization or institution,
or if the meeting is held in voters settlement,
then it is sealed by the stamp of the public
utilities services or the relevant municipalities.
4.4. The citizen who has been nominated by the
initiative of the Con.EC shall submit the following
documents:
1) notification on candidate nomination (sample
of the notification shall be attached to this
Instruction);
2) ID card or the copy of its substitute document
of the candidate (this document must be approved
in the notary order);
3) application of the candidate (the agreement
application on nomination should contain surname,
name, patronymic, date of birth, permanent residence
in the Republic of Azerbaijan and place of residence,
serial number of ID card or its substitute document,
place of job or service, occupation (if not
any then kind of activity), party membership
of the candidate nominated. This application
shall be approved in the notary order.) A candidate
can include the information on his/her party
membership in the application. In this case,
the candidate agrees with the Con.EC to name
the political party not more than in 5 words.
If the political party indicated in the application
has excluded the candidate from its membership
and sent a notification to the Con.EC , then
the name of the political party can not be used
related to this candidate after receiving this
notification;
4) The application on commitment (this application
should contain the commitment on the termination
of the activity incompatible with the post when
the candidate is elected). This application
should also contain the information about his/her
biography (surname, name, patronymic, date if
birth, address of residence, education, main
job or service place). The name and number of
the appropriate Article of the Criminal Code
if the candidate did not serve or if the candidate
has committed an action that caused liability
in a foreign country and if the court adopted
enforced decision on this, if this action causes
criminal liability implied by the Criminal Code
of the Republic of Azerbaijan, then the name
of the appropriate law of the foreign country
should be indicated. The application of the
candidate should also contain not only the information
about the citizenship of the Republic of Azerbaijan
but also foreign citizenship and commitments
before other countries if there are any.
If an authorized representative has been appointed:
5) application on agreement of the authorized
representative or representatives (this application
shall be approved in the notary order);
6) list of the authorized representative or
representatives of the candidate;
7) the warrant of the authorized representative
or representatives given by the candidate (the
warrant shall be approved in the notary order);
4.5. For the nomination of the candidate by
voters initiative groups not only the documents
implied by item 4.4. of the Instruction, but
also the following documents (excluding first
point of the item 4.4. of the Instruction )
shall be included:
1) protocol of the meeting on establishment
of voters initiative group (sample of the protocol
is attached to the Instruction);
2) notification on the initiative to nominate
candidate during the Elections to the Milli
Majlis of the Republic of Azerbaijan (sample
of the notification is attached to the Instruction);
3) list of the members of voters initiative
groups (the list should contain the surname,
name, patronymic, date of birth, address of
residence, serial number of ID card or its substitute
document and signature);
5. The candidate or his/her authorized representative
shall be provided with written reference on
the reception of the documents submitted by
the Con.EC
6. The Con.EC considers the submitted documents
within 5 days and provides the candidate or
his/her authorized representative with the decision
on the approval or refusal of the candidate
nomination.
