COMMENT
on the usage of de-registration
card for voting (voting card) in Elections to
the Milli Majlis of the Republic of Azerbaijan
The voter with
active suffrage shall have the right to use
voting card (de-registration card) in the territory
considered single constituency pursuant to Article
29.9 of the Election Code and the rules for
its usage have been defined by Article 101 of
the Election Code of the Republic of Azerbaijan
and Instruction “On the rules for the issue
of de-registration card for voting” approved
by the Decision 11/70 by the Central Election
Commission of the Republic of Azerbaijan dated
on July 12, 2004.
According to Article 82 of the Constitution
of the Republic of Azerbaijan and Article 143
of the Election Code of the Republic of Azerbaijan,
the territory mentioned during Elections to
the Millie Males of the Republic of Azerbaijan
is not a single constituency, but single-mandate
constituencies in the same number for electing
125 deputies with only one deputy for one constituency.
As it is obvious, the voter with active suffrage
shall have the right to express his/her will
only in the territory that he/she lives and
with the aim of electing a registered candidate
during Elections to the Millie Majlis of the
Republic of Azerbaijan.
In accordance with the above-mentioned and Articles
25.1 and 25.3 of the Election Code of the Republic
of Azerbaijan, the Central Election Commission
of the Republic of Azerbaijan comments with
the aim of providing voters` suffrage and coordinating
activity of Constituency and Precinct Election
Commissions (Con.ECs and Pecks):
Application of rules for using voting cards
(de-registration cards) defined by Article 101
of the Election Code of the Republic of Azerbaijan
and Instruction “On the rule for the issue of
de-registration card for voting” approved by
the Decision 11/70 of the Central Election Commission
of the Republic of Azerbaijan dated on July
12, 2004 is possible only within the territory
of the constituency where the voter has been
included in the voters list.
Note:
Samples 1 “A”, 1 “B”, 1 “C” and
1 “Ç” of application forms to be submitted to
the Con.ECs or PEC by the voter or his/her authorized
representative in order to receive de-registration
card for voting.
