INSTRUCTION
ON STATUS OF CANDIDATES
TO PRESIDENCY OF THE REPUBLIC OF AZERBAIJAN
AND AUTHORIZED REPRESENTATIVES OF POLITICAL
PARTIES AND
BLOCKS OF POLITICAL PARTIES
1. The status of a
candidate to presidency of the Republic of Azerbaijan
and authorized representatives of political
parties and blocks of political parties shall
be regulated in accordance with the Election
Code of the Republic of Azerbaijan.
1.1. The candidate
to presidency of the Republic of Azerbaijan,
as well as the political parties and blocks
of political parties that have nominated a candidate,
shall identify their authorized representatives.
The authorized representatives shall be appointed
by the candidate or in accordance with decision
of a meeting, congress or conference of political
parties or political parties constituting a
block, or by decision adopted at the meeting
of another superior body. One of such representative
shall be responsible for financial issues.
1.2. The authorized representative of a candidate,
political party or block of political parties
shall carry out his/her functions on the basis
of the Power of Attorney approved by a notary
office.
1.3. The list of authorized representatives
shall be submitted to the Central Election Commission,
and except for the authorized representatives
on financial issues, the list is shall also
be submitted to the constituency election commission.
1.4. The authorized representatives shall be
issued with badges by the Central Election Commission.
1.5. Each authorized representative of a political
party and block of political parties shall performs
his/her functions on the basis of a decision
of the meeting of a political party, political
parties constituting a block or representatives
of such parties, which indicates his/her powers,
surname, name, father’s namepatronymic, date
of birth, the serial and number of his/her identification
document or substitute document, address of
residence, working place, occupation or official
duty (service job) (if he/she does not have
them – type of activity); and for the authorized
representative on financial issues – the samples
of financial documents and stamps for such documents.
In addition, a written consent of each person
to be an authorized representative should be
attached to the relevant list submitted to the
Central Election Commissionmust of each person.
This form shall be approved at the session of
the Central Election Commission.
1.6. The authorized representative can conduct
a campaign in support of the registered candidate.
The authorized representatives can make written
request to the relevant executive authorities
with respect to conducting meetings with electors.
The venues (building, room) which are suitable
for performing of pre-election activities shall
be provided free of charge by the owners, for
holding meetings with electors at times agreed
with the relevant election commissionare. The
authorized representatives shall determine the
date of paid publication of the pre-election
campaign materials is through the lottery conducted
by the periodicals, on the basis of written
requests, with participation of the interested
persons. The authorized representatives can
obtain the list of locations allocated for displaying
pre-election campaign materials from the relevant
Constituency Election Commission.
1.7. The authorized representatives can conduct
meetings with electors who are within the territory
of military unit, when such meetings are arranged
by the commanders of those military units together
with the constituency election commission, provided
that all registered candidates, all political
parties or blocks of political parties with
candidates registered for this constituency
are necessarily invited to or informed about
this meeting at least 3 days prior to this meeting.
1.8. The authorized observers shall have the
right to observe and be entitled to all rights
and responsibilities provided to observers by
the Election Code of the Republic of Azerbaijan.
Such persons shall have the right to observe
meetings of the election commissions, vote counting,
as well as the conduct of relevant work concerning
ballot papers, voters’ registers, de-registration
cards for voting, voting results and outcomes,
get familiarized with such documents, obtain
copies of decisions of election commissions
and other election documents (except for voters’
registers, de-registration cards for voting,
ballot papers and signature sheets), and to
observe other election actions implemented by
the election commissions.
1.9. The authorized representatives who are
still working for government or municipality
cannot use their occupational or service position
during the process of elections.
1.10. The authorized representatives on financial
issues shall submit their reports three times
within their activity period – when signature
sheets are submitted to the Central Election
Commission, when 10 days are remaining until
the election day, and within 10 days after the
election results are published officially.
1.11. The registered candidate, political party
or block of political parties at any time withdraw
their authorized representatives and appoint
another persons instead of them, by notifying
the relevant election commission. If there is
such a kind of notification, the election commission
shall cancels the verification card of the withdrawn
authorized representative. Anytime upon his/her
own initiative, the authorized representative
can resign from his/her position and return
his/her card to relevant election commission
by informing the registered candidate, as well
as the political party or block of political
parties.
1.12. The term of office of the authorized representatives
of political parties and blocks of political
parties shall commences from the day they are
appointed, and ends by the date the Constitutional
Court announces officially the election outcomes,
or by the finishcompletion of the status of
candidacy of the candidates nominated by political
parties and blocks of political parties.
