COMMENT
on the specification of voters lists

1. In order to exercise the citizens` voting rights voters lists should be compiled pursuant to Articles 46 and 47 of the Election Code of the Republic of Azerbaijan by considering the followings:
1.1. Permanent voters lists shall be approved by the Precinct Election Commission (PEC) on each polling station up to March 30 in the form defined by the Central Election Commission and specified at least 35 days prior to the voting day. After a while (including the voting day) a voter shall be included in the voters lists only according to the court decision (in this case court decision shall be attached to the voters lists).
1.2. The voter included in the voters list but unable to vote in the relevant polling station can get de-registration card 3 days prior to the voting day. In this case the relevant election commission makes relevant notes on the right corner of the surname column of voters indicated in the voters lists and these voters should not be included in the total number of voters.
2. While getting ballot papers voters who are to vote with de-registration cards must indicate their address of residence in the de-registration card and must sign them.
2.1. The voter who is to vote with de-registration card shall not be included in the voters lists and only the de-registration card should be attached to the voters lists and these voters shall be included in the total number of voters.
3. Permanent voters lists should include the information of heads of relevant executive authorities, heads of municipalities, commanders-I-chief of military units on the voters with active suffrage. Temporary voters lists should include the information of diplomatic representations of the Republic of Azerbaijan to foreign countries or consulate departments, as well as heads of institutions temporarily settled by voters and citizens of the Republic of Azerbaijan with active suffrage on voters.
4. Voters lists on the polling stations established in the places temporarily settled by voters (in hospitals, sanatoriums and rest-homes), ships navigating on the voting day should be approved by the relevant PEC according to the information of the head of the institution temporarily settled by the voter, ship captain on voters and to the information checked in the PEC at least 5 days prior to the voting day.
4.1. Voters lists on the polling stations established in remote districts should be specified by the relevant PECs according to the information on voters submitted by heads of relevant executive authorities and municipalities at least 25 days prior to the voting day, in the exceptional cases 2 days after the establishment of the PEC.
5. All citizens with active suffrage shall be included in the voters lists.
5.1. In order to include a citizen in the voters lists on the polling station this fact shall be taken as a basis that the citizen is required to live in the area of the polling station at least 6 months of previous 12 months before the declaration of elections.
5.2. If the fact was revealed that the citizen has not lived in the relevant area within the above-mentioned time, then he/she should not be included in the voters list compiled on the polling station that covers this area.
5.3. The citizens of the Republic of Azerbaijan who live in foreign countries can vote in the representations or consulate departments of the Republic of Azerbaijan to these foreign countries in the relevant case pursuant to the law.
5.4. The citizens who changed their permanent residence for education, were called for military service and were demobilized from the military service shall vote with de-registration cards got by PECs and Con.ECs where they have been included in the voters lists in the polling stations that cover their new area.
