REGULATION
By Constituency Election Commissions
on control - inspection service
The regulation defines
the legal state, duties and rules of activity
of Constituency Election Commissions (Con.ECs)
during the Presidential Elections of the Republic
of Azerbaijan, Elections to the Milli Majlis
of the Republic of Azerbaijan, Referenda and
Municipal Elections.
I. Common provisions
1.1. Control-inspection service in the Con.EC
shall be formed pursuant to Article 97 of the
Election Code of the Republic of Azerbaijan.
1.2. The composition of the control-inspection
shall include three commissioner on the representation
norm of the Con.EC (on the representation of
political parties that constitute majority in
the Milli Majlis, political parties that constitute
minority and non-parties) and officials of relevant
state bodies: district departments of the Ministry
of Finance of the Republic of Azerbaijan, local
taxes offices and Baki city taxes department
of the Ministry of Taxes of the Republic of
Azerbaijan and departments of Universal Joint
Stock Bank .
1.3. Control-inspection service shall be organized
during the office term of the Con.EC.
1.4. During its function control-inspection
service adopts the Election Code of the Republic
of Azerbaijan, normative acts adopted by the
Central Election Commission of the Republic
of Azerbaijan, decisions by the Central Election
Commission of the Republic of Azerbaijan and
other legislative acts of the Republic of Azerbaijan
as a basis.
1.5. Form by the Con.EC shall be used for official
correspondences of control-inspection service.
II. Duties of the
control-inspection service
2.1. Control-inspection service implements the
control on the usage of the funding allocated
for election commissions on its destination,
proper registration of election funds and their
usage.
III. Functions of
control-inspection service
3.1. By the commission of the Con.EC control-inspection
service:
3.1.1. checks the finiancial report of lower
election commissions;
3.1.2. submits relevant documents on financial
frauds of Precinct Election Commissions (PECs)
while election financing;
3.1.3. inspects other issues related to financing
of elections pursuant to the legislation;
3.1.4. copiles an act or reference on the results
of inspection and submits the Chairman of the
Con.EC.
IV. Rights of control-inspection
service
4.1. Rights of control-inspection service:
4.1.1. to require information and reference
on the issues related to its authority from
the PEC;
4.1.2. get necessary references and information
on the issues related to control-inspection
service and financing of elections from executive
bodies, municipalities and organizations notwithstanding
kind of property and from citizens;
4.1.3. put a task before the Con.EC or the Central
Election Commission on taking relevant measures
about citizens and legal entities, candidates,
registered candidates, political parties, blocks
of political parties and campaign groups on
the Referenda in the case of their fraud in
the financing of elections.
V. Rule for the
formation of Control-inspection service
5.1. Head of control-inspection service shall
be appointed and dismissed by Decision of the
Con.EC.
5.2. Members of control-inspection service shall
be included in composition of control-inspection
service by the Con.EC with the agreement of
relevant state bodies. Relevant specialists
shall be sent by relevant bodies to be included
in the composition of control-inspection service
since the official publication of the Decision
on the determination of elections up to required
time by the order of the Con.EC. Upon setting
members of control-inspection service of their
main work, they get supplementary salary in
the form and capacity defined by the Central
Election Commission by keeping salaries and
other payments on the main job-places.
5.3. Specialists included in the composition
of control-inspection service can be sent to
official service trips by the order of Chairman
of the Con.EC and on the account of the Con.EC
on the presentation of the head of control-inspection
service.
VI. Rights and duties
of the head of Control-inspection service
6.1. Head of control-inspection service:
6.1.1. organizes the activity of control-inspection
service and reports to the Con.EC on its activity;
6.1.2. conducts work division among the persons
included in the composition of control-inspection
service and specialists involved in the work
of this service, setes tasks before them and
controls on their implementation;
6.1.3. gives inquiries to relevant offices and
organizations and gets information;
6.1.4. involves experts for the conduct of inspection
and preparation of expert opinion by the commission
of the Con.EC.
VII. Final
provisions
7.1. The Regulation shall be approved by the
Central Election Commission of the Republic
of Azerbaijan.
7.2. Appendices and amendments to the Regulation
can be made by the Decision of the Central Election
Commission.
