R E G U L A T I O N
ON STATUS OF PERSONS APPOINTED AS AGENTS DURING ELECTIONS OF THE PRESIDENT OF THE AZERBAIJAN REPUBLIC
1.This status shall be regulated in accordance with the Election Code of the Azerbaijan Republic.
-The registered candidate and the political parties and blocks of political parties with registered candidates, can appoint up to 50 agents.
-Such persons shall be registered by the Central Election Commission and issued with special verification cards.
-The agents shall be registered within 3 days from the day of receipt of written application of the candidate or application of political party, block of political parties, campaign group on referendum on appointing agents, as well as the written consent of citizens on being an agent.
-The mentioned applications or written consents shall indicate surname, name, patronymic of each agent, as well as his/her date of birth, main working place, occupation (if none – the type of activity), home address, serial, number and issue date of his/her ID or substitute document.
2.The agent shall have the following rights to:
-
participate in pre-election campaign for the registered candidate;
-
apply to the relevant executive authorities with a request to allocate venues for holding meetings of candidates to presidency with the electors;
-obtain from the constituency election commission the list of locations allocated for displaying pre-election campaign materials;
-
organize meetings with electors who are within the territory of military unit, when conduct of such meetings is determined by the commanders of those military units together with the constituency election commission, provided that all registered candidates, all political parties or blocks of political parties with candidates registered for this constituency are necessarily invited to or informed about this meeting at least 3 days prior to this meeting;
-
apply to the Central Election Commission for participation in the process of preparation of ballot papers, protocols and envelopes;
-
observe the course of elections;
-
observe meetings of constituency and precinct election commissions, vote counting, as well as the conduct of relevant work in constituency and precinct election commissions concerning ballot papers, voters’ registers, de-registration cards for voting, voting results and outcomes;
-
get familiarized with such documents; obtain copies of decisions of election commissions and other election documents (except for voters’ registers, de-registration cards for voting, ballot papers and signature sheets), and to observe other election actions implemented by the election commissions;
-
be at any time during the voting day in the voting station of the relevant election precinct;
-
observe issuance of ballot papers and envelopes for ballots to the voters, during the voting day;
-
calculate the number of voters, and to observe counting of ballot papers, as well as the invalidated ones;
-
apply with offers and comments concerning organization of the elections to the chairperson of the precinct election commission, and if s/he is absent, to the substitute person;
-
apply to the court with regard to decision of the Central Election Commission or actions (or lack of actions) of its members;
-
resign anytime upon his/her own initiative from his/her position and return his/her card to the Central Election Commission, informing the registered candidate, as well as the political party or block of political parties, the authorized representative that appointed him/her;
-
other actions which are not prohibited by law.
3.The agents shall be prohibited:
-
for the agents holding position in the state and municipal bodies to use their occupational and service position during the course of elections;
-
to campaign within territories of military units, in military organizations or institutions;
-to obstruct the implementation of the powers of the election commission members during the election day, to force the voters to vote for one or another candidate;
-to ask a voter how he or she will vote, or has voted;
-
to sign a receipt of a ballot paper on behalf of a voter who requests it;
-
to mark the ballot paper upon the voter’s request;
-
to make actions and calls directed to supporting other candidate, political party and to make actions and calls that can be considered as support of candidate, political party;
-
if the agent is an official, journalist and creative worker occupied in television-radio broadcasting, and mass media editorial office he or she is not permitted to participate in display of the course of the elections in the mass media;
-
to make actions those prohibited by law.
4.The registered candidates, political parties, blocks of political parties can any time withdraw the persons they appointed as agents and appoint other persons instead of them by the way of informing the Central Election Commission. If there is such information, the verification card of the agent shall be canceled.
5.The authorities of the agent shall commence from the day of their registration by the relevant election commission and finish at the day of official announcement of the information about the final returns of the elections by the Constitutional Court of the Republic of Azerbaijan.
