R E G U L A T I O N

on rules for formation of Precinct Election Commissions

1.The Precinct Election Commissions shall be established by the relevant Constituency Election Commissions at least 40 days prior to the voting day.
The PEC consists of 6 members. The Precinct Election Commission members shall be appointed by the relevant Constituency Election Commission.
1.1 3 members of the Precinct Election Commission shall be nominated by the Constituency Election Commission members who represent the political party deputies of which, elected from multi-mandate (nationwide) election constituency, are in majority in the Milli Majlis; 1 member shall be nominated by the Constituency Election Commission members who represent the political parties deputies of which, elected from multi-mandate (nationwide) election constituency, are in minority in the Milli Majlis; 1 member shall be nominated by the Constituency Election Commission members who represent the deputies elected from single-mandate election constituencies; and the other 1 member shall be nominated by the Constituency Election Commission members who represent 4 political parties which have not gained seats in the Milli Majlis and collected the majority votes in the elections on multi-mandate (nationwide) election constituencies.
1.2 The nominees for the membership of the Precinct Election Commission shall be presented to the Constituency Election Commission members representing the political parties in the   Constituency Election Commission by the local organizations of the relevant political parties.
2.The nominees for the membership and substitutive membership of the Precinct Election Commission shall be presented to the Constituency Election Commission members representing the deputies elected from single-mandate election constituencies in the following way:

2.1In order to nominate a candidate for Precinct Election Commission in each polling station the initiative group of voters consisting of at least 10 persons shall call a meeting. After the chairperson and secretary are elected the following 2 issues shall be included to the agenda:
1st issue – nomination of a candidate for the membership of the relevant Precinct Election Commission.
2nd issue - nomination of a candidate for the substitutive membership of the relevant Precinct Election Commission.
The protocol of the meeting shall contain the name, surname, patronymic, address of residence, serial and batch number of the identification document or the document substitutive to it, signature of each member of the initiative group and the date of conduct of the meeting.
2.2 The members of the initiative group of voters, the persons nominated for the membership or the substitutive membership of the Precinct Election Commission should reside within the territory of the relevant constituency or administrative territorial unit.
2.3 The decision on presentation of the nominee for the membership of the relevant precinct election commission and nominee for substitutive membership shall be adopted in the meeting. The chairperson of the meeting and his or her secretary approve the adopted decision and the protocol of the meeting by signing them.
2.4 If the meeting is held in the office, institution or in the organization the adopted decision and the protocol of the meeting shall be approved using their stamp, if it is held for the place of residence of the voters, the decision and the protocol shall then be approved with the stamp of the housing department or with stamp of the municipality. The decision and protocol can also be notarized.
2.5 After adopting the decision the initiative group of voters shall submit the approved decision, protocol and the application of assent of the candidates along with the written application to the relevant constituency election commission members representing the deputies elected from single-mandate election constituencies in the constituency election commission.
2.6 The members of the initiative group of voters and the nominees for the membership of the precinct election commission should be neutral.
2.7 The constituency election commission members representing the deputies elected from single-mandate election constituencies shall investigate and approve the submitted documents and introduce them to the session of the relevant constituency election commission for adoption of the decision providing one member with decisive voting right and one substitutive member for each election precinct. The constituency election commission shall adopt relevant decision upon it.
