INSTRUCTION

ON ORGANIZATION OF ELECTIONS IN SHIPS THAT NAVIGATE UNDER THE STATE FLAG OF THE AZERBAIJAN REPUBLIC, OIL PLATFORMS LOCATED IN THE AZERBAIJANI SECTOR OF THE CASPIAN SEA, IN HOSPITALS, SANATORIUMS, REST HOMES AND DETENTION INSTITUTIONS, DURING ELECTIONS OF THE PRESIDENT OF THE AZERBAIJAN REPUBLIC


1. In accordance with Article 35.4 of the Election Code of the Republic of Azerbaijan, if number of voters is more than 50, the voting stations can be created within at least 50 days prior to the Election Day by a relevant constituency election commission on oil platforms located in the Azerbaijani sector of the Caspian Sea, in ships that navigate on the election day and in the places where the voters are temporarily residing. With this purpose, the constituency election commission shall apply to the Caspian Shipping Company, State Oil Company of the Republic of Azerbaijan and administration of institutions where the voters are temporarily residing, and identify the exact number of voters.

1.1. If number of voters on oil-platforms located in the Azerbaijani sector of the Caspian Sea, in ships that navigate on the election day and in the places where the voters are temporarily residing is less than 50, the voting stations shall be created within at least 5 days prior to the election day, and organization of voting be charged with the captain of the vessel or the administration of institutions where the voters are temporarily residing. Such voting precincts shall be subordinate to the election constituency they are situated in, or where the vessel is registered.
1.2. Voters’ registers for the precincts established in the places where the voters are temporarily residing or in the ships navigating on the election day shall be approved by the precinct election commission within at least 5 days prior to the election day, based on the information provided by administration of institutions where the voters are temporarily residing or by the captain of the vessel and checked by the precinct election commission.
1.3. Delivery of the election documents to the ships that navigate under the State Flag of the Azerbaijan Republic and oil platforms shall be ensured by the Caspian Shipping Company and the State Oil Company of the Azerbaijan Republic.
1.4. Information on voting results can be delivered to the ships that navigate under the State Flag of the Azerbaijan Republic, as well as to the oil platforms and oil-extracting platforms located in the Azerbaijani sector of the Caspian Sea, via radio or other communication means, if no relevant means are available.

2. Election precincts can be organized in hospitals, sanatoriums or rest home only in the cases, if the average number of the citizens with active suffrage that have come to such places before the day of determination of elections and stay there for treatment or recreation for at least 5 days, is more than 50. Information on the average number voters who are under treatment or having rest, shall be verified on the basis of application provided by administration of the hospital, sanatorium or rest home. If the number specified in the application, is either less or more than 50, but does not represent the facts, then no precinct shall be established. The heads of institutions that provide erroneous information shall be subject to liability in the order specified by legislation. The election precincts shall be established in accordance with decision of the relevant constituency election commissions at least 50 days prior to the Election Day, or, in exceptional cases, on the basis of a decision of the Central Election Commission, within at least 5 days before the election. Such election precincts shall be included in the election constituency they are situated in.

2.1. Administration of institutions of confinement or pre-trial detention centers shall collect and specify information about the voters, and submit it to the relevant precinct election commissions 35 days prior to the election day.
2.2. The persons which are not sentenced by a court’s decision which is in legal force, and which are subject to preventive punishment shall in accordance with the information provided by administration of pre-trial detention centers be included in the voter’s register.
2.3. If no precinct elections are established in institutions of confinement or pre-trial detention institutions, then 2 members of the relevant precinct election commission shall take ballot papers and envelopes in the amount which is appropriate to the number of voters in those institutions, and ensure conduct of voting, in presence of observers.
2.4. Administration of pre-trial detention centers shall submit to the closest precinct election commission the written applications for voting provided by the persons detained in administrative order. 2 members of the precinct election commission shall close and seal the mobile ballot box and ensure voting by the persons detained in administrative order.
2.5. The persons with active suffrage, serving their sentence in institutions of confinement shall vote with special cards developed and approved by the Ministry of Justice of the Azerbaijan Republic.
2.6. Draft special card shall be agreed with the Central Election Commission. The special card shall include the photograph and date of birth of the sentenced person, and be approved by signature and stamp of the head of the institution of confinement. 2 members of the election commission shall take ballot papers and envelopes in the amount which is appropriate to the number of prisoners plus 0.5% more, and ensure conduct of voting, in presence of observers.
