INSTRUCTION
ON RULE OF ISSUANCE OF DE-REGISTRATION
CARDS FOR VOTING
1.
Requirements concerning the form, order of preparation,
number, issuance register form and development
of the de-registration card for voting (hereinafter
– the voting card) shall be approved by the
Central Election Commission at least
60 days before the voting day. The voting cards
shall be prepared in the order provided for
in Articles 99.2-99.5 of the Election Code.
Responsibility for issue and keeping of the
voting cards shall be imposed on chairpersons
of the relevant election commissions.
1.1. The voter that
has obtained a voting card can vote with it
in the election precinct, which is within the
territory where the voter is on the Election
Day.
1.2. After receiving the de-registration cards
for voting from publishing house, the Central
Election Commission shall in presence of the
chairperson and secretaries of a relevant constituency
election commission draw an act, indicating
the number and date and time of issue of the
de-registration cards for voting, and submit
it to the chairperson of the constituency election
commission, at least 50 days prior to the voting
day. This act shall be stamped by the stamp
of the Central Election Commission.
1.3. The constituency election commission shall
in presence of the chairperson and secretaries
of a relevant precinct election commission draw
an act, indicating the number and date of issue
of the de-registration cards for voting, and
submit it to the chairperson of the precinct
election commission, at least 30 days prior
to the voting day. Such an act shall be signed
by the chairperson and secretaries, and stamped
by the stamp of the constituency election commission.
2. Chairpersons of
constituency and precinct election commissions
shall be responsible for issue and keeping of
the de-registration cards for voting.
2.1. The de-registration
cards for voting shall be issued by the relevant
election commission to the voter according to
his/her application, or to the voter’s representative,
based on a power of attorney verified by a notary
office. The voter’s application should indicate
the reasons why the voter is not able to come
to the precinct on the Election Day.
2.2. The precinct election commission should
apply to the constituency election commission
within two days after receiving the voter’s
application, and clarify whether the voter has
obtained a voting card before or not. Since,
provisions of the Election Code of the Azerbaijan
Republic prohibit issue of more than one voting
card to a voter.
2.3. The constituency election commission shall
make a register of issuance of de-registration
cards for voting. The voter’s surname, name,
patronymic, date of birth and address should
be indicated in the register. The constituency
election commission shall send the voters lists
together with the verified extracts from the
mentioned register to the precinct election
commission, 25 days before the Election Day.
Based on such extracts, each precinct election
commission should make relevant notes in the
voters’ lists.
2.4. When receiving from the constituency election
commission a de-registration card for voting,
a voter or his/her representative authorized
by a power of attorney shall sign the register
and indicate the series and number of his/her
ID or substitute document. In this case the
cut-off corner of the voting card shall be attached
to the register. The de-registration card for
voting issued to the voter by the constituency
election commission shall be confirmed by the
stamp of that constituency and signed by a member
of the constituency election commission.
2.5. When receiving from the precinct election
commission a de-registration card for voting,
a voter or his/her representative authorized
by a power of attorney shall sign the voters
list and indicate the series and number of his/her
ID or substitute document. In this case the
cut-off corner of the voting card shall be attached
to the voters list.
3. Based on this, the
voter shall not be taken into account when counting
the registered voters and included in the relevant
protocol. The de-registration card for voting
issued to the voter by the precinct election
commission shall be confirmed by the stamp of
that precinct and signed by a member of the
precinct election commission.
3.1. The relevant
precinct election commission shall deliver to
the relevant constituency election commission
the information on the de-registration cards
for voting issued to voters, and the relevant
constituency election commission shall, in its
turn, once in two days pass such information
to the Central Election Commission.
