I N S T R U C T I O N

on organizing the Presidential elections of the Republic of Azerbaijan outside the borders of the Republic of Azerbaijan

Diplomatic representatives and consulates of the Republic of Azerbaijan are responsible for the implementation of suffrage of the citizens of the Republic of Azerbaijan living outside of the Republic of Azerbaijan in accordance with Article # 35.6 of the Election Code of the Republic of Azerbaijan.
Registration of the citizens of the Republic of Azerbaijan to voter lists living outside the borders of the Republic of Azerbaijan or being in long-term foreign business trip is based on the fact of their living outside the borders of the Republic of Azerbaijan constantly and much, as well as being in long-term foreign business trip determined by the diplomatic representatives or consulates of the Republic of Azerbaijan.
Election precincts for organizing voting for voters located in foreign states and counting of these votes shall be created in the territories where these voters reside, by the heads of diplomatic representations or consulates of the Republic of Azerbaijan, provided that number of voters registered with the consulate is more than 50, at least 30 days prior to the voting day.
If the diplomatic representatives and consulates of the Republic of Azerbaijan do not exist in the foreign state in voting day or the election precincts are not organized in accordance with the Article # 35.6 of the Election Code of the Republic of Azerbaijan in the diplomatic representatives and consulates of the Republic of Azerbaijan, then the citizens of the Republic of Azerbaijan in those states do not participate in voting.
Organization of voting is permitted to be charged with at least 2 (two) staff of the diplomatic representative and consulate in places (if the number of voters is less that 30) where the election precincts are not created.
Voters living outside the borders of the Republic of Azerbaijan are registered by election constituency. The Ministry of Foreign Affairs of the Republic of Azerbaijan provides the Central Election Commission (CEC) with the information on the number of voters registered in the corresponding diplomatic representations or consulates of the Republic of Azerbaijan, living outside the borders of the Republic of Azerbaijan constantly or being in long-term foreign business trip. On the basis of the information, the CEC approves the lists of the corresponding election constituencies for the registration of the voters in presidential election period.
The lists of the voters by election precincts created outside the borders of the Republic of Azerbaijan is approved by the corresponding Precinct Election Commission (PreEC) at least 25 days prior to the voting day on the basis of information on voters given by the heads of the corresponding diplomatic representations or consulates of the Republic of Azerbaijan.
The CEC with the Ministry of Foreign Affairs provides the deliverance of the election documents to the election precincts placed in diplomatic representatives and consulates.
When the voting is finished by the CEC and Constituency Election Commission (ConEC) information received by fax from the election precincts situated in abroad is entered to the protocol on the result of voting.
The election precincts created outside the territory of the Republic of Azerbaijan, the problems on publishing the results of the election and voting is solved by the heads of the corresponding diplomatic representatives and consulates of the Republic of Azerbaijan by taking the local conditions into consideration.
Ministry of Foreign Affairs of the Republic of Azerbaijan shall take important measures to provide continuos contacts with the election precincts organized in the diplomatic representative and consulate situated in abroad.
