I N S T R U C T I O N
On rules for transference and return of voluntary
registration deposits
1. Rules for transference and return of voluntary
registration deposits shall be regulated by
Articles 58.5, 60.5 and 73.2 of the Election
Code of the Republic of Azerbaijan and this
Instruction.
1.1. While submitting signature sheets and other
documents for registration of the candidate
to presidency of the Republic of Azerbaijan
(hereafter referred to as the candidate to presidency),
at the same time a bank document on transference
of voluntary registration deposit amounted to
3 percent of the maximum limit of the relevant
election fund , i.e.
165 000 000 manat to the account of the Central
Election Commission that implements registration
can be submitted. This document should contain
the destination of payment, i.e. words of “for
registration deposit”.
1.2. Election fund of the candidate to presidency,
political parties, blocs of political parties
can not be used while transference of voluntary
registration deposit to specific account of
the Central Election Commission allocated for
the deposit.
2. If the candidate to presidency is not registered,
then the leading authority of the candidate,
political party (blocs of political parties)
that nominate the candidate can appeal with
an application on registration by the Central
Election Commission (with name, surname, patronymic,
serial number of identification card of the
candidate, date and number of the decision on
rejecting the candidacy) providing that not
to return voluntary registration deposit.
2.1. In this case the Central Election Commission
registers the candidate to presidency within
2 days. In all other cases voluntary registration
deposit shall be returned to the candidate,
the candidate to presidency, political party
that nominate the candidate, blocs of political
parties within 3 days after adoption of the
relevant decision on registration and refusal
from registration by election commissions.
2.2. If the candidate to presidency can not
gain 3 percent of votes of voters, then voluntary
registration deposit is not returned. If the
candidate to presidency is elected president
or gains 3 percent of voters votes, registration
deposit is returned to the former candidate
to presidency by the Central Election Commission
within 3 days after official publication of
election results.
3. If the registered candidate to presidency
withdrawals his/her candidacy without any obligatory
cause (serious illness of the registered candidate
approved by the relevant medical expertise specified
by the Labor Code of the Republic of Azerbaijan
and regarding incapability to function by the
court, or health disorder of the candidate to
presidency during election campaign as a result
of reasons that makes impossible his/her participation).
