INSTRUCTION
on rules for nomination of candidates
to membership of Constituency Election Commission
1.1 Constituency Election Commissions shall
be organized at least 90 days prior to the
voting day by Central Election Commission. Constituency
Election Commission consists of 9 members. Central
Election Commission appoints members of Constituency
Election Commission.
1.2 Candidacy of three members to Constituency
Election Commission shall be presented by the
members of the Central Election Commission who
represent the political party, deputies elected
on single multi-mandate constituency of which
constitute majority in the Milli Majlis, candidacy
of two members –by commissioners who represent
political parties in the Central election Commission,
deputies elected on single multi-mandate constituency
of which constitute minority in the Milli Majlis,
candidacy of other two members-by commissioners
who represent deputies elected on single one-mandate
constituency in the Central election Commission,
candidacy of two members –by commissioners who
represent four political parties in the Central
election Commission which are not represented
in the Milli Majlis and gained much vote during
elections on single multi-mandate constituency.
1.3 Local organizations
of relevant political parties present candidates
to membership of Constituency Election Commissions
to commissioners who represent in Central Election
Commission.
2. Candidates to membership of Constituency
Election Commissions and decisive members present
deputies elected on single mandate constituency
to commissioners representing in the Central
Election Commission in the following case.
2.1 Voters’ initiative group of 15 persons is
to be formed for the nomination of candidate
to Constituency Election Commissions on each
constituency. After election of chairperson
and secretary 2 issues are included in the agenda.
- 1st issue- the nomination of candidate to
the relevant Constituency Election Commission;
- 2nd issue – the nomination of substitute candidate
to Constituency Election Commission. The minutes
of the session should contain name, surname,
patronymic, address of residence, serial number
of identification card or substitute document,
and date of signature of each voter participating.
2.2 The decision on nomination of candidacy
of persons to membership of Constituency Election
Commission and candidacy of substitute member
shall be adopted in the session. Adopted decision
and minutes of the session shall be approved
by chairperson and secretary of the session
by being signed by them.
2.3 The seal of division, institution, organization
shall certify the decision and mniutes of session
of voters’ initiative group, if it took place
in such places, by the seal of apartment exploitation
department or by appropriate municipality if
session took place on the settlements of voters.
Decision and minutes can be certified in notary
office as well.
2.4 After adoption of decision voters’ initiative
group sends the approved decision, minutes of
the session and candidates’ application on consent
to the Milli Majlis of the Republic of Azerbaijan.
Candidates nominated on m all constituencies
are united in the Milli Majlis of the Republic
of Azerbaijan and presents to Central Election
Commission.
2.5 Members of voters’ initiative groups and
candidates to membership of Constituency Election
Commissions shall be non-partisan.
2.6 During the organization of Precinct Election
Commissions candidates are nominated to commissioners
who represent deputies elected on single-mandate
constituencies in the Constituency Election
Commissions from the territories of precincts
in the case specified by Articles 2.1, 2.2,
2.3, 2.4 and 2.5 of the Instruction. But during
the organization of Precinct Election Commissions
the number of voters’ initiative groups shall
be not less than 10 persons. After adoption
of the decision, voters’ initiative group sends
the approved decision, minutes of the session
and the candidates’ application on consent to
the relevant Constituency Election Commission.
