REGULATION
on control and inspection service under Central
Election Commission
This regulation defines
legal status, duty and responsibility of control
and inspection service of the Central Election
Commission in Presidential Election, in election
to the Milli Majlis in referendum and on municipal
elections.
I. Common Provisions
1.1 Control and inspection
service in the Central Election Commission shall
be formed in accordance to item 97 of the Election
Code of the Republic of Azerbaijan.
1.2 Members of Central Election Commission and
employers of its Apparatus, employers of relevant
state bodes: Ministry of Finance of the Republic
of Azerbaijan, Ministry of Taxes of the Republic
of Azerbaijan, National Bank of the Republic
of Azerbaijan and Counting Chamber of the Republic
of Azerbaijan shall be included in the composition
of the control and inspection service.
1.3 Control and inspection service shall be
formed in term of office of the Central Election
Commission of the Republic of Azerbaijan.
1.4 In its activity control and inspection service
takes as a basic Constitution of the Republic
of Azerbaijan, Election Code of the Republic
of Azerbaijan, other legislative acts of the
Republic of Azerbaijan, decision of the Central
Election Commission and this regulation.
1.5 For official correspondence of the control
and inspection service application forms of
the Central Election Commission shall be used.
II. Duties of control
and inspection service
2.1 Control and inspection
service implements control of expenditure of
funding allocated for election commissions,
proper registration and use of election funds,
receipt of funding to the election funds of
candidates, registered candidates, political
parties and blocks of political parties, registration
of these funds and purposed expenditure of these
funds.
III. Function of control
and inspection service
3.1 In the instruction
of Chairman of Central Election Commission:
3.1.1 inspects financial reports of candidates,
registered candidates, political parties and
block of political parties, campaign group on
referendum and subordinate election commissions:
3.1.2 Prepares documents on financial violation
occurred during the finance of election,
3.1.3 Inspects other issues related finance
of elections according to the legislation,
3.1.4 Compiles an act and reference on results
of inspection and submit it to the Chairman
of the Central Election Commission.
IV Rights of control
and inspection service
4.1Control and inspection
service shall have following rights:
4.1.1 To require information related to their
authority from candidates, registered candidates,
election commissions, political parties and
block of political parties and intuitive group
on referendum
4.1.2 To obtain necessary information on issues
concerning control and inspection service, and
finance of elections from the executive authorities,
municipalities, organizations-regardless their
property and citizens
Reports of control and inspection service should
be replied within ten days, but five days prior
to the election day and on the election day-immediately
4.1.3 To set a task before Central Election
Commission on implementation of measures of
accountability for the violation occurred during
finance of election by physical and legal entities,
candidates, registered candidates, political
parties and blocks of political parties
V. Rules of formulation of control and inspection
service
5.1. Head of control
and inspection service shall be appointed and
dismissed by the decision of the Central Election
Commission
5.2. Members of control and inspection service
are included in the composition of the service
by chairman of the Central Election Commission
by agreement of the heads of relevant state
bodies.
5.3 Relevant specialists must be sent at least
5 months to the order of Central Election Commission
from relevant bodies for including to the composition
of control and inspection service after the
publication of decision on determination of
elections
5.4 Members control and inspection service are
temporarily released from their employment,
their salaries and other payment will be preserved
in their permanent working place and they are
paid additional salary in accordance rules and
amount defined by the Central Election Commission
5.4 Specialist included in the composition of
control and inspection service shall be send
on the basic of the head of control and inspection
service with the order of chairman of the Central
Election Commission by the allocation of Central
Election Commission to the business trip
VI Duty and responsibility
of head of control and inspection service
6.1 Head of control
and inspection service:
6.1.1 Organizes activity of control and inspection
service and make report about activity to the
Central Election Commission
6.1.2 Distributes responsibilities between persons
included in the composition and specialists
involved in the activity service, gives instructions
to them and controls their fulfillment
6.1.3 Makes inquiry with relevant institutions
and organizations and receive information
6.1.4 Involves experts for preparation expert
opinions and conduct of inspection
VII. Final provisions
7.1 Amendments
and appendices to this regulation can be made
by the decision of the Central Election Commission
